      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

Just thought I'd share my experience with Kwikfit Center local to me in west wales, basically I took my bmw there for a hunter 4 wheel alignment this is meant to be an all singing and dancing alignment adjusting everything possible not just toe angle but camber castor etc.. After I had just fitted £400 worth of front tyres so wanted the alignment spot on

Anyway took it there one evening about 530 they were quite busy but was assured they had to time to do it before they closed at 6pm

Waited a bit before the car was taken on the ramp, fitter comes back yep all done for you that's £34.95 gave me invoice and printout of before and after.

That evening I looked at the printout to discover the left aphand front and rear camber had not been adjusted and was still in the 'red' when correct settings show green.

So took it back next morning guy on desk explains it will be £19.95 pre adjustment for camber I told him this is what I wanted to start with anyway off he went.

Only to return 20mins later to say that whoever did it the previous day put the wrong settings in the computer so set my alignment up wrong but he will fix it now.! So what was the printout he gave me off then a random one he had living about no doubt!!

An hour goes by and he returns to say the tie rod ends are totally seized solid,bearing in mind these were supposed to have been adjusted yesterday, when I asked how this could be as they were only turned yesterday not even 24 hrs ago actually, he started to stutter and say oh well he must have turned them but because he had the wrong settings didn't need to go that far!! Absolute bull**** and the look on their face was a picture as they knew they had been caught out! So anyway another hour past and they claimed all done but looking at the printout it showed the camber just as before hadn't been touched and they said they can't adjust this which Is the reason why i went there in the first place!

By this time as I has my young daughter with me I left before I lost my temper which I'm glad I did.

I therefore had no confidence in what was done with my car and wasn't sure if it was correct so drove 40 miles to a specialist independent tyre specialist that uses the exact same machine.

I explained what had happened and they put it on their ramps with weights added to the car to simulate a load and then setup the rear first which would then be able to work the front alignment out which he did all in about 20 mins and yep you guessed even after the second visit to Kwikfit still wasn't correct this cost me £60 so not only did I have to pay £34.95 for Kwikfit to set my car up wrong I then had to pay £60 to fix their problems!

So angry at myself that I used them!

Also debit card!!!

Thanks guys, I have emailed them to see what they have to say etc, but nothing back, yes I used my debit card for the purchase, safe to say I will never use them again nice expensive kit but they haven't got a clue how to use it!

I'd just fitted brand new Goodyear tyres and if I hadn't gone back the second time they would have been chewed to bit in a few thousand miles
