PLEASE HELP !!!

I have sent my Data Protection Subject Access Request to which I had absolutly no response.

 

I have also sent "LETTER BEFORE ACTION Section 7 – Data Protection Act 1998" to which I have had no response.

I have some statements which add up to about £2000, but I do not think I have all of them.

I am not sure what to do now...

Please help!

failed to comply letter sent 3rd October 2006

Still no reply from Halifax 25th October 2006

OK, will try and e-mail them...

 

Is there any template to use or do I just tell them what I think of them (I better not... Yet)

 

Is it worth going in to a branch as I work right next to one!

 

btw, They have cashed the cheque a few days after it was sent, so they have definatly recieved it!

personally i would steer away from ringing and visiting branches(as you always get fobbed off )

 

you can send letter or email whatever is your preference

"You send a non compliance letter dated 3rd Oct, have you carried out the actions you stated you would in this letter?"

I have not yet as I am not sure what to do next. The letter was one of the templates from this site, the letter said:

 

 

You have failed to comply with my Data Protection Act Subject Access Request dated 23rd August 2006.

If you do not comply within the next 7 days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice.

 

How do I go about getting a court order?

Please could someone post a link of how to fill out a N1 form or a link with details of "Moneyclaim"

hi, Not to sure if you can file for this on MCOL because it is primarily the Data that you are after.

 

You will need to give a monetary value of the claim otherwise it will cost you more in fees.

 

If you read my thread http://www.consumeractiongroup.co.uk/forum/halifax-bank/10610-morgan054-halifax.html you will see the idea.

 

Use the template http://www.consumeractiongroup.co.uk/forum/bank-templates-library/6971-data-protection-act-non.html to fill in the N1 form

 

I put costs of 2 x Registered letters plus stationery at £10 to the "Value" on the form so it only cost me £30 court fee which of course you get back, the only thing is you will need to take it to your local County Court.

 

Hope that is clearer for you but if in doubt just shout

I am a bit worried, as I did not send anything recorded or registered...

The cheque for £10 I sent has been cashed, so I hope that will be proof of the SAR, any idea if this will affect the case, and how much should I claim for in the N1 form?

 

Also do you know if there is a time limit for me doing this, or is the sooner the better...

Hi, If you still need to file your N1 then the sooner the better, like tomorrow, The value is basically to recover your costs while allowing you to keep out of "part 8".

 

Remember it is the data that you require most so you can proceed to next stage, the money is secondary hence i only added a true cost of £10.

 

You can of course start your bank charges claim using the statements you already have, and estimate the remainder, It is up to you, or wait until all the info is with you.

 

The template is in the library for filling in the N1 and the N1 is available to fill in too, just remember when filling in N1 to print off 3 copies before you finish as all details will be erased

 

Read through the template before you begin,then modify it to suit especially the parts in red, then just cut & paste to N1

Does anyone know if you can request details for more than one account on the SAR?

 

When I sent the SAR I put details of all my Halifax accounts as the template said "account numbers". Have I made a mistake, if I have should I start again or should they have sent the details to me...

 

I am only wandering about this as the N1 template says:

 

"2. The Claimant (has/had) an account number (Insert Account Number) ("the Account")"

 

If I can use a SAR for more than one account do I need to file different N1 forms or will all the accounts work on one N1?

 

Please help, as I am really confused now!

I have now received a letter from the Halifax with a complete load of waffle talking about their complaints procedure etc.

 

Not to forget saying they have enclosed a copy of the complaints procedure leaflet, which I have heard so much about! (they actually forgot to put one in, that will save a bit of tree)

 

The letter was signed by:

(Just in case anyone wants to send any more complaints her way)

 

Should I give them a bit longer or should I just go to the local county court?

Better late than never...

 

I had almost given up getting my statements and was tempted to make a guess. I decided to call them instead of all the letters and e-mails.

I spoke to someone who was really helpful and said I would receive the statements in the next few days, which I did!

 

I have now sent 4 prelims off with a total of £3,000 ( I would only have guessed about £2,000!)
