  1. They might have put it in the bank when they sent the "full and final" letter, sometimes they do this... Which rejection letter did you send? I am at the same stage but I no longer have the account so they said they would send a cheque after the 14 days.
  2. I have looked at the refusal letters in the FAQ Section, but I am still unsure which letter to send. The letter from the bank says "Full and Final settlement of your complaint" and they will issue a cheque in 14 days. The letter was received After the expiry of the LBA, but before court action From what I understand, letter 5 and 6 are not applicable unless I have started court action. there are no further conditions attached so letter 2 is out. Letter 4 is also out as it is a "Full and Final" offer. So I am not sure if I should use letter 1 or 3... Please help!

  5. I am not sure if any of this makes sense. I am confused too :? I am trying to find out what to do next...
  6. I have used the complex bank charges spreadsheet which you can see part of below, this gives the total penalty charged as £221 and interest on penalties as £256.74 (note: I have cut out the spreadsheet as it did not paste)
  7. I have just received a letter back from Halifax making an offer for just the charges (£221). The spreadsheed for complex bank charges shows £256.74 interest on charges and there is also the 8% on top of this. Should I get all of this back and which letter would I send to refuse this offer as there are six different ones. I have not gone to court action just yet as I got the letter on the day I was going to court to put the claim in. Halifax also say I have 14 days to reply to the letter dated 18th April 2007 Thanks for any help you can provide
  8. Better late than never... I had almost given up getting my statements and was tempted to make a guess. I decided to call them instead of all the letters and e-mails. I spoke to someone who was really helpful and said I would receive the statements in the next few days, which I did! I have now sent 4 prelims off with a total of £3,000 ( I would only have guessed about £2,000!)

  10. This matter was on BBC's Watchdog on the 14th March, they suggest to write a letter to the company that is charging the non direct debit fee. Letter to cut and paste below... ------------------------------------------------------------------ [YOUR ADDRESS] [ADDRESS OF COMPANY – list of company addresses are below] Dear Sir or Madam, I am writing to protest about your penalty charge for customers who do not pay by direct debit. I think this charge is unfair and does not reflect the true cost of processing my payment. It seems to me simply a way of increasing your revenue. Provided I do so on time, it is my right to pay my bill however I choose. Why should I pay more just because I don't use your preferrred payment method? I urge you to reconsider this unreasonable charge. But if you insist on continuing with it, I would expect you to demonstrate that the charge is justified. You will be aware that the law says penalty charges must be fair. I do not believe that this is the case with yours, but look forward to hearing your explanation.   11. I have about 4 claims on a prelim at the moment with Halifax... Does anyone know if a Halifax loan can be claimed, I have had 9 charges at £10 each and one charge for £50 plus the interest that goes with them from 2003! I am not sure if the £10 is too low to claim. also does anyone know if excessive interest rates can be claimed back? I have now received a letter from the Halifax with a complete load of waffle talking about their complaints procedure etc. Not to forget saying they have enclosed a copy of the complaints procedure leaflet, which I have heard so much about! (they actually forgot to put one in, that will save a bit of tree) The letter was signed by: Sharon Cook Customer Relations Manager Core Business Team Customer Relations 01383 426 823 (Just in case anyone wants to send any more complaints her way) Should I give them a bit longer or should I just go to the local county court?
  14. Does anyone know if you can request details for more than one account on the SAR? When I sent the SAR I put details of all my Halifax accounts as the template said "account numbers". Have I made a mistake, if I have should I start again or should they have sent the details to me... I am only wandering about this as the N1 template says: "2. The Claimant (has/had) an account number (Insert Account Number) ("the Account")" If I can use a SAR for more than one account do I need to file different N1 forms or will all the accounts work on one N1? Please help, as I am really confused now!
  15. Thanks morgan054, that is really helpful. I am a bit worried, as I did not send anything recorded or registered... The cheque for £10 I sent has been cashed, so I hope that will be proof of the SAR, any idea if this will affect the case, and how much should I claim for in the N1 form? Also do you know if there is a time limit for me doing this, or is the sooner the better... Thanks.
