      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It is that, but there is also an element of self help too.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Just an update on this. After countless emails to countless email addresses at Wonga. I had a repayment plan agreed 3 days before due date via the system in the end and still no responses (aside from automated ones) to my emails from a normal human being that is able to read or communicate.

 

I made a payment on Saturday over and above their installment of £80 which according to my bank was accepted. Low and behold they have still taken out their installment on top of that today. MY CPA cancellation was sorted out in time so I will receive that money back thankfully.

 

I have contacted the OFT about this and also will be contacting the Ombudsmen. It's unacceptable that an organization as large as this can get away with what feels like a deliberate ploy to make it as difficult as possible for lenders to set up plans and to have anything agreed in writing.

Hold up. You cancelled the cpa yet it was still taken? Time for a complaint to your bank. The transaction should have been denied, not allowed to go through and then be refunded.

Creating a repayment plan should be simple. However, banks and creditors make it as hard as possible. But they would waste no time in stalling if they owed you money.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Can someone help me with this please. Wonga have come back to me with the below. I have sent them 3 emails chasing them on a decision on my repayment plan offer over a 4 month period. I understand it's best to not communicate with them over the phone... They've sat on this now for 2 days.

 

After reviewing your email, it seems clear the best way to get this matter sorted is over the phone.

So whilst I thought this was sorted Wonga have now changed the dates of the payment arrangement. I luckily have kept screen prints of everything. Also the total amount payable keeps changing, any advice on what to do, I have already logged a complaint with the FOS about them

 

Background is:

 

1) Repayment arrangement was initial payment on 23rd November and thereafter payments on 3rd of each month starting 3rd January 2014 (this is to allow enough time for the bank transfer to get to them as I will pay 25th of each month) - All on print from account

 

2) I received an email today stating that they were unsuccessful in debiting payment for 3rd December and if I don't pay by 10pm tomorrow then they will stop the arrangement and charge me the interest! a) I've told them no less that 15 times that I will pay via bank transfer and not to attempt to take the monies from my card. b) I also checked my Wonga account and dates and amounts on the payment arrangement have completely changed without any notification to me, this has resulted in an extra payment due today and an additional amount of £15 being added to the total.

 

I've sent three emails but have had nothing back... Just so fed up this, it's just a simple request and is just a nightmare to try and get straight...

Oh dear, these people do have issues reading don't they.

 

Check your bank to ensure no Direct Debit has been set up and to ensure no other CPA has been as well.

 

Is there any named individual you can email? If not, another complaint will be needed.

 

Never set up DD or allow CPA. You are doing the right thing by doing it by bank transfer. This pi**es them off as they can't control anything

If you are asked to deal with any matter via private message, PLEASE report it.

If you stick to the arrangement they agreed with you, then there is no way in the world they will ever be able to force you to pay any charges and interest.

 

All I can say is to stick to the agreement you made with them,

if they wish to play silly beggars then, that is their look out and their financial loss.

 

Keep copies of all payments you make to them, just stick to what they agreed too!

 

Whilst you lodge a second complaint to them, also drop one into the OFT&TS, give BBC Watchdog your story too, seems they need some more bad publicity.

Hi again,

 

I am still having a nightmare with Wonga on this, have already contacted FOS and I can further escalate in a couple of weeks.

 

So the arrangement is in place and has been for a couple of months, I pay slightly over and above what was agreed so I can get it paid off quickly.

 

You can log in and see the status of what you owe as part of your repayment plan (apologies if you already know this) Anyway this amount changes on a daily basis. My initial repayment total was £800.30 and now if you add up all the payments due and what I have already paid it amounts to £880.30.

 

Any advice on this or other people that have had the same issue. I know some people have spoken about the interest amount not freezing when you log in and look at the 'today you owe' section, that's not what I am talking about, it's the arrangement details that concern me and those installment amounts and ultimate total shouldn't change. I have sent so many emails now, not once have I had a straight answer on the total amount owed, they just direct you to the website which isn't static (I have screen printed everything luckily) but what a pain!

So you have now paid how much?

 

If it covers the amount you physically took, then IMO I would stop all payments.

They will soon contact you to ask where their beer money is......have you got records of everything you have sent/paid?

Transfer fees? Explain? if theyve charged you 27.50 simply to put it in your account, then either reclaim it or contest the interest accrued as you never actually recieved that money and it doesnt cost them 27.50 to send it to your bank.

Really sorry I'm probably not clear, really confused myself.

 

The cash amount that I borrowed was £660, this was made up of 5 smaller transactions over a period of a couple of weeks. I was charged £5.50 for each of those transactions totalling £27.50. the difference between those two amounts and my balance to pay (£814.05) is £126.55 (which is the interest amount applied).

 

I have paid two payments totalling £165 (£85 and £80) so my balance should be £649.05, I've cut and pasted below what the website currently says. Essentially the larger amounts below are balances after the lower payment amount is made (hope that makes sense).

 

Actually as I've typed that all out I've realised that Payment 1 is the second payment instalment I have made so it does add up roughly. Apologies I have my stupid hat on today! Sorry!
