    • dx is wrong there. The reason they did the application with a hearing is likely that they had questions of the application that weren't answered in their wx. nothing to do with your N180 no they are just saying that they want the extension to make it 7.
    • its not a fine! it is NOT A FINE.....this is an extremely important point to understand no-one bar a magistrate in a magistrates criminal court can ever fine anyone for anything. Private Parking Tickets (speculative invoices) are NOT a criminal matter, merely a speculative contractual Civil matter hence they can only try a speculative monetary claim via the civil county court system (which is no more a legal powers matter than what any member of Joe Public can do). Until/unless they do raise a county court claim a CCJ and win, there are not ANY enforcement powers they can undertake other than using a DCA, whom are legally powerless and are not BAILIFFS. Penalty Charge Notices issued by local authorities etc were decriminalised years ago - meaning they no longer can progress a claim to the magistrates court to enforce, but go directly to legal enforcement via a real BAILIFF themselves. 10'000 of people waste £m's paying private parking companies because they think they are FINES...and the media do not help either. the more people read the above the less income this shark industry get. where your post said fine it now says charge dx

    • I already phoned them.  It was for a parking fine submitted by CP Plus issued by solicitors DCB in 2022!  I'll ring again tomorrow and do as you said 😇 Hard to believe such a harmful thing as a CCJ can be issued when there's no proof of anything!!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

Renewed my claim April 12 30hr element.dad became ill mid April and passed away 30th may.during may/June I had time off unpaid,never crossed my mind at this time to ring tax credits.I carried on working went to docs on 19th sept and was signed off sick.I then started claiming ESA,asked jobcentre if I was to inform tax credits they told me no.I then phoned tax credit help line April 1st 13 to cancel it as I'd been off work 27 weeks and didn't know if I would be returning to work,handed my notice in may 10th. got a compliance letter from Belfast asking for p60,wage slips.I rang Belfast and spoke to a woman explaining all this,she was not nice at all and said to send the evidence in.which I did recorded delivery.worried sick because my p60 is so low,but didn't realise I was doing anything wrong.this year has been hell and to top it off I have this and just got 0 on my atos examination.any advice? will I be prosecuted? This is Making me feel more ill suffering from severe depression not eaten for 2 days.

Everything turned upside down mid April when my dad became ill may June had time off unpaid.went back to work became very depressed,claimed ESA from sept.I was still employed up to may this year.I thought I could claim ESA while still getting wtc.but i cancelled after 27 wks thinking this was the right thing to do.but my p60 is nothing like the prediction I made for the year.woman on phone in Belfast was vile,basically said I didnt have a job.which I did have.

Thanks,I did read that and that's why I cancelled my claim on the 1st April.thing I'm worried about is I didn't tell tax credits I was off sick as an idiot at the jobcentre said I didn't need to.will they make me pay the year back.

they might class it as an over payment in which case it will have to be paid back either in full or in instalments depending on what agreement you come to. there is always a risk of prosecution as in every case but id wait and see what they come back to you with.

 

i know its hard but id not worry about that at the moment until you know what there reply will be. you have been though a lot with the passing of your father. just wait and see what they say them come back and let us know and we can see if we can advice you further on this. ther have been a few cases like this on here recently so people are aware. and do get into these situations .

 

do you know where you stand with appealing your ESA decision do you know what to do with regards to appealing etc ect?

Yes thanks I posted a question and got some advice on appealing.I accept if I've been overpaid but it was a genuine mistake.I've read other posts and my case doesn't seem so bad in comparison to others.Many thanks for your help.

I received a letter back from compliance officer today.it's says 'I have completed my checks into your reward.I accept the information you gave us and do not need to amend your tax credits

Thankyou for sending the following documents etc.'

Does this mean everything's ok and there's no overpayment.

You're fine - I was wondering if they had checked previous awards. If you've got the final award with no overpayments you're in the clear. A huge weight off your mind, lot of worry for you on top of your other personal stress x

Yes it is thanks,glad it's all completed,didn't think I'd done anything wrong but it's quite scary getting one of those letters! If they checked previous years it would have been spot on.just my ESA to sort now!

Hi wonder if anyone can help me .Filled in tax credit renewal wrong put down income twice.Phoned them and the advisor said she would remove one of the incomes.Just feel really nervous am receiving wrong information.Can anyone help?

What do you need help with? You've made HMRC aware of your error, they said they'll rectify it, you haven't had anything to say they haven't acted on your info, right?

 

Just wanted to make sure I won't be penalized for making the error.Had no paperwork through and was just a bit worried .
