Thanks HB,confused as when I rang the job centre to stop my esa payments,she told me esa payment & appeal would be stopped,but what do they know!!

Just to clarify can I attend the tribunal even tho I'm not claiming esa.

Hi I started claiming esa sept 12.had atos cross examination April 13 failed with 0 points,I appealed this and kept sending fit notes.i ended my claim in oct and returned to work.i was told when I ended my claim that the appeal would be stopped.i have just recieved a letter saying my appeal date is 23rd dec.can I still appeal if I'm not currently claiming esa. Thanks

Yes it is thanks,glad it's all completed,didn't think I'd done anything wrong but it's quite scary getting one of those letters! If they checked previous years it would have been spot on.just my ESA to sort now! Thanks for your reply Ali

Hi It's from 2012-2013.such a relief they actually owed me some money.got a letter from Preston with final award.

Hi I did ask to be paid assessment rate on gl24.Iike u said I'm going to go through all the lies and presumptions that have been written & about the advice about 3 month return to work.I don't want to be off work but I need time to get better.I didn't put alot on the form thought I'd better get it in asap,but did say I would be sending further evidence.As for reconsideration 100% sure that's a NO.was very naive going to atos,wish I'd read about it before.15 min to tell me I'm not depressed.absolute disgrace! Will my payments start again when they get gl24? No money for 3 wks now.not signing on. Thanks for your help

Sent GL24 off this morning didn't want to wait any longer for esa85 but it has just come through the post.atos has written 'I advise that work could be considered within 3 months' does this mean dwp decision maker over ruled her advice.shall I write to dwp adding more evidence after reading esa85. Thanks for any replies.

Hi I failed my atos assessment got 0.Have been signed off sick since sept with depression/anxiety after the death of my father.Idiot at atos has basically said I'm absolutely fine esa65.waiting for esa85.Twisted it all and some things have been presumed and are not true.in the six weeks since this assessment my doc has doubled the dosage of my anti depressants and have seen a mental health worker at my GP & have been told I need in-depth bereavement counselling before I will start getting better.do I put this on gl24? & what else should I write? I find it hard to go out,get panic attacks and generally feel frightened at the moment.Do I say atos got it wrong? Thankyou for any advice

I received a letter back from compliance officer today.it's says 'I have completed my checks into your reward.I accept the information you gave us and do not need to amend your tax credits Thankyou for sending the following documents etc.' Does this mean everything's ok and there's no overpayment. Thanks.

Yes thanks I posted a question and got some advice on appealing.I accept if I've been overpaid but it was a genuine mistake.I've read other posts and my case doesn't seem so bad in comparison to others.Many thanks for your help. Ali

Thanks,I did read that and that's why I cancelled my claim on the 1st April.thing I'm worried about is I didn't tell tax credits I was off sick as an idiot at the jobcentre said I didn't need to.will they make me pay the year back.

Everything turned upside down mid April when my dad became ill may June had time off unpaid.went back to work became very depressed,claimed ESA from sept.I was still employed up to may this year.I thought I could claim ESA while still getting wtc.but i cancelled after 27 wks thinking this was the right thing to do.but my p60 is nothing like the prediction I made for the year.woman on phone in Belfast was vile,basically said I didnt have a job.which I did have.

Thankyou Margaret,I will ring dwp first thing mon.just not sure about sick note as I already sent one off to the dwp to cover me 10th may-10th June.don't know if doc will issue me another.they'd already made there decision on the 25/04 but they didn't send letter letting me know until 14/05.so complete waste of time sending that note in.at my wits end with it all !
