Reg 35 of the employment n support allowance regs. It's the reg that covers being treated as having limited capability for work related activity cos of:

Risks to mental or physical health

Treatment for cancer

Processing of tribunal decisions by Jobcentreplus can take anything from a few days to several weeks. If you've not heard anything within two weeks or so it's worth phoning to check they've not lost their copy of the decision.

Sincerely, Margaret.

what happens if they ahve lost the papperwork descesion one

Hello there. I don't think this happens very often. Do you have a copy of the decision? And I would hope there's also a record at the tribunals service. Unless your appeal was within the DWP itself and went to a decision maker.

From reading your other thread you had an oral hearing of your appeal in front of an employment n support tribunal panel, earlier this month.

Some benefit delivery centres are way behind with the processing of appeal decisions; it's probably just a case of waiting until yours gets to the top of the pile. If necessary, a further copy of a decision notice can be requested from the Tribunals Service for up to six months after the hearing.

Sincerely, Margaret.
