So after a 14 day investigation with p2g i had a live chat with them yesterday ( 8th June) who said they didnt know where the parcel was but closed the case as i didnt take out their protectiove insurance.  So now at 07.33 on the 9th of june i was repling to this thread with all the relivent information to start a claim and i check the tracking of the 'Lost' parcel for specific dates to find the tracking has updated and the parcel is now at the recipients local depot  ? which is annoying because ive already refunded the buyer as i didnt want any negative feedback as it was an ebay listing and id want a refund if i was in his postion. So i posted the parcel with Evri on the 20/5/24  The delivery date was missed due to it being sent to the wrong depot and a case was opened on the 25/5/24 14 Investigation failed to locate the item in Evri's system and case closed on the 8/6/24 and now the tracking has updated on the 8th saying its at the recipients depot so is likey to receive it in the next few days .... Typical.  Oh well nevermind , thanks everyone

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I will be opening a new thread when I start my fight with Nat West, but thought I would share this with you, the week before Christmas, I cancelled quite a few direct debits as I knew there would be no money in the account, on 2nd January, nat west tried to pay them, therefore resulting in over £300 charges on my account, so when my wages went in yesterday, it just left me with enough to pay my mortgage & nothing else, so I would not be able to pay other bills or buy food for the rest of the month. I was on the phone to them constantly, but they weren't a bit concerned about the situation they had left me in & told me they were not going to refund the money. So I fired of an angry email late Thursday night to them, and told them that if they didn't refund the charges, as it was their mistake, I would be getting in touch with the press. This morning I received a letter of them to say that they were going to refund all the charges from this week and it will go straight back into my account, so hooray. This has now spurred me on to get everything back from them from the last 6 years, so once I start the ball rolling, I will open a new thread and keep you informed.:-)

Don't know if anyone can help me on this, but when you have been charged, are you supposed to get a letter of nat west saying you have been charged for unpaid items, I have never received a letter of them.

 

NatWest haven't sent letters for years.It means you might not find out about a returned item until it is represented and they charge you a second time. Nice bit of extra income for them.

I know Lloyds still send letters but not sure about other banks.

Received cheque yesterday for the £100 AQ fee, so that seems to be Nat West done and dusted. I will still make them wait a bit though before sending in the Notice of Disscontinuance, afterall they certainly made me wait!!

i HVAE JUST ISSUED AN OL-LINE SUMMONS FOR THE AMOUNT OF MY CLAIM WHICH IS GBP4,531.00 PLUS INTEREST AND HAVE SENT A STATUTORY DEMAND TO GORDON PELL AT NATWEST HEAD OFFICE. THEY HAVE ONLY SENT A PARTIAL REPLY TO MY FULL SUBJECT ACCESS REQUEST, IF THE BALANCE OF THE INFORMATION IS NOT RECEIVED WITHIN HE SPECIFIED TIMESCALE I WILL FILE A COMPLAINT WITH THE INFORMATION COMMISSIONER AND NOTIFY THE FSA. I WILL POST FURTHER UPDATES AS THEY ARIS

Thanks for your comments. I used to be a director of a bank in London so I am quite familiar with the compliance people at the FSA. I have notified Clive Briault, their Managing Director, Retail Markets, of the poor standard of management and NatWest and suggested that the FSA should commission a Section 39 report in accordance with the Banking Act 1987 as amended to cover the staff training and continuing professional education standards applied by NatWest/RBS. In the event that NatWest do not provide in a timely manner all of the data I have requested in my SAR I wil be sure to notify the Information Commissioner. Regards & thanx again

Humble apologies if I have caused the confusion on this thread, perhaps my posting about NatWest and my reply to TideTurner's comments was the one on which Muggins73 was commenting, hence the gender confusion. I had better sort this out by starting my own thread.

At least my letter of complaint and a Statutory Demand sent to Gordon Pell (copied to Clive Briault at the FSA) have prompted an instant response from Aslam Abid at Group Customer Relations in Bishopsgate. I await a warm and encouraging communication from Cobbetts in due course....
