I can prove that I had to buy a new washing machine, I have my pay slips showing the emergency tax code and a letter from the tax office after I had spoken with them to get it corrected and of course I can get a copy of my vet bill. And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Help....

 

I currently have 2 credit cards that i have fallen behind with payments on and defaulted (AMEX & Barclaycard)

 

I now have 2 seperate Debt Collection Companies in contact with me via post threatening to commence legal proceedings to recover sums if i dont make immediate payments.

 

I acknowledge the debts but am not in a financal position where i can make immediate payments to bring the arrears up to date and then as requested set up monthly Direct Debits.

If i was to start paying monthly again it would only be a small amount so i would never reduce the debt due to the interest, where do i stand with asking for the interest stopped ?

This would allow me to start repayments and actually start to reduce the debt

any help would be VERY much appreciated

Try that letter first, if they fail to stop interest and charges just set up a standing order NEVER a direct debit, and pay them £1 a month.

 

Who are the DCA's chasing for payment?

How much roughly is owed?

How old are these accounts?

When did you start to default on them?

And what have they sent you?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Write to explaining how much you can afford to pay and why and ask for their bank details so you can pay it, do not pay by direct debit as they will fleece you. If it is only £1 a month so be it.

Never ever speak on the phone to them and keep a log and copy of all correspondence, especially if they phone you. If they do phone don't get into a conversation, don't answer any security ID questions and tell them writing only. When they get funny, which they will for sure, you can do a CCA request or even claim back charges.

Your letter could also ask them for an interest freeze. Keep it civil and nice until they get funny then you can get the ball rolling with the big bat. Don't let it worry you, you are able to start months of letter tennis full of meaningless threats, so you know what to expect.

the DCA's chasing me are Moorcroft for AMEX and Poer Contact for Barclaycard (although letter says i can also deal with Mercers DCA)

I owe approx £2200 on AMEX and £2500 on Barclaycard

AMEX started in 2004 and Barclaycard in 2000

 

I defaulted on AMEX about 14 months and Barclaycard about 18 months ago. Unfortunately i also bank with Barclays and on 2 seperate occasions they have taken £150 from my cuurent account without my knowledge (money which i hadn't planned for and wasn't spare or disposable)

 

Moorcroft have made a 'Home Visit' and left me a Direct Debit form to return and Power Contact / Mercers have threatened a home visit and legal proceedings

You need to open another bank account with a different banking group or they will continue to offset (steal from your account)

 

Mercers IS Sharklaycard. it's their own in house DCA, Powerless2contact are just that Powerless!

 

As for Moorcr@p they are fantastically incompetent.

 

Any such fool that thinks they can turn up on your doorstep demanding money or answers to uneducated questions can be told to foxtrot oscar, they are NOT bailiffs, and they have NO legal powers to do anything, if they don't clear orf, call the Police and have them removed.

 

No contact via phone or face to face, keep everything in writing only.

With Baclays there is a lot of 'Late Payment' charges / fees, in fact i'm confident there may be some PPI on there too, as for AMEX they have stopped adding late fees.

OK using the hardship route you should attempt to get these refunded with sharklays as well as the PPI if it has failed to kick in and do it's sole purpose.

 

You might also be able to use COBS on both cards?

Thanks Bazooka, just out of interest if a DCA is unable to provide a CCA what does this mean ?

As long as the CCA is pre 2007 then it means they cannot enforce/carry out any legal action against a debtor because they don't have the required paperwork to carry it out.

 

Post 2007 then most, if not all, agreements will be deemed compliant, especially if thy were taken out online..
