  2. thanks for your response, Amex still own the debt so don't really know why Moorcroft are chasing and insist that i pay them and not Amex. SAR will be sent asap to Amex, if there is charges and PPI how would i got about reclaiming these (what would be my first step ?) appreciate tge quick responses and have put my mind at rest

  4. Hi Guys looking for some advice. i've recently been contacted via a doorstep visit by Moorcroft chasing a credit card debt of £2600 (Amex) which i stopped paying about 15 months ago. In all fairness he was polite and non-pushy and just asked me to fill a direct debit form in and leave out for him to collect at a later date. I didn't do this as was under the impression that it would be unwise to do direct debit and should offer a standing order instead. He has now chased me by phone insiting that it must be a direct debit form as they don't accept standing order, the only other option is that i call him every month and make a payment over the phone. I've asked him to get a breakdown of the account showing charges, interest and any PPI as the statements i have just show the total balance due. He has said they can't obtain this. Now earlier on tonight i had a phonecall from him telling me he was on his way round as he had been instructed to visit me urgently to reslove. I wasn't in at the time but just wondered what my next action should be ? Should i request a CCA / SAR from Amex or offer very low payments ? I'm not really in a financial position to commit to anything at the moment Any advice would be very much appreciated many thanks
  5. Hi ims21 The last payment made was approx 4 years ago, do you know why would Monument not send out the Statement of Account with the credit agreement etc and leave the DCA to do this ? many thanks

Hi CitizenB Thanks, Monument have sent me all of the above apart from the Statement of Account which they say C.A.R.S will forward to me. i have checked my credit report to see who the owner of the debt but it dosn't come up on there. Monument have just said that C.A.R.S are dealing with the account so i don't know if they've brought the debt or are just acting on behalf of Monument. They claim that i owe approx £600, would they take me to court for this amount ?
  7. Hi Guys Am looking for abit of advice. Last month i recieved a letter from a DCA called C.A.R.S threatening Doorstep visits regarding an old Monument credit card debt. I responded by writing to them requesting all contact to be made in writing and also requested a CCA (i used the template letter from the CAG library) Today i recieved a letter from Monument (who i didn't think existed anymore) with a copy of what looks like my original credit agreement dated 20th September 2003 and a copy of the original T&C's. Where do i stand with: 1- the age of the debt 2- do Monument even exist anymore The letter also says that C.A.R.S will be servicing this account and they will provide me with a 'Statement Of Account' and that they consider the Credit Card Agreement to be fully enforcable and that there is no dispute, is this actually the case ??? Any help or advice on my next move would be very much appreciated thanks
  8. Hi Low, It just said 'Please find enclosed Postal Order for account that we are no longer dealing with, please contact the client direct quoteing ref number ********' The client is Santander who i am bout to send a CCA request to aswell hope this helps
  9. thanks, just to let you know that i sent a letter to ScotCall requesting a CCA and within 2 days had a reply with my postal order for £1 infirming me that they are no longer dealing with the debt
  10. Hi Guys, just thought i'd update you following my posts above. After receiving the letter from ScotCall regarding DoorStep visits i sent a letter requesting CCA along with a postal order for £1 as recomended. Well today a received another letter from ScotCall along with my Postal Order explaining that they are no longer dealing with this debt. Thanks for all the advice, i wouldn't of got by without everyones help.....thanks

Hi Guys After recently receiving 'Home Visits' by ScotCall regarding an old Topman card (via Santander) i sent them a letter requesting future correspondance to be in writing and that a 'Doorstop Visit' was not welcome (i sent letter from CAG Library) ScotCall have very kindly written back to me this morning stating: "The case you have referred to is not applicable to your circumstances, as part of the credit agreement that you entered into, you agreed to pay the full balance and where necessary, the creditor could recover debt by outsourcing the debt to a third party, which included by way of doorstep collection" "Therefore the license that you state has been revoked and is irrelevent, we are entitled by law and under contract to recover monies outstanding and we are allowed to take reasonable steps in accordance with regulatory guidance to recover such monies" Please Help - I am posting a CCA Request to them this morning, but just wanted to check where i stand with regards to doorstep visits, if i request all contact to be in writing and that i don't want a doorstep visit don't they have to agree to this under OFT Guidance etc ? Any help would be very much appreciated Thanks

Hi Today i received a letter from a DCA called C.A.R.S (Creditlink Account Recovery Solutions), they state that they will be attempting to visit me at home within the next week to 'Establish Reasons For Non-Payment' to an old Monument Credit Card (balance of £620.21) which must date back to at least 4 years ago. I have responded by sending them a letter back requesting all communication to be made via letter and no doorstep callers and will immediately follow up with a CCA request. However i've just looked at my Credit Report which lists everything but for some reason this debt is nowhere to be seen on it, what does this mean and is it to my advantage ? many thanks

  15. With Baclays there is a lot of 'Late Payment' charges / fees, in fact i'm confident there may be some PPI on there too, as for AMEX they have stopped adding late fees.

Hi Bazooka Boo the DCA's chasing me are Moorcroft for AMEX and Poer Contact for Barclaycard (although letter says i can also deal with Mercers DCA) I owe approx £2200 on AMEX and £2500 on Barclaycard AMEX started in 2004 and Barclaycard in 2000 I defaulted on AMEX about 14 months and Barclaycard about 18 months ago. Unfortunately i also bank with Barclays and on 2 seperate occasions they have taken £150 from my cuurent account without my knowledge (money which i hadn't planned for and wasn't spare or disposable) Moorcroft have made a 'Home Visit' and left me a Direct Debit form to return and Power Contact / Mercers have threatened a home visit and legal proceedings many thanks
  17. Help.... I currently have 2 credit cards that i have fallen behind with payments on and defaulted (AMEX & Barclaycard) I now have 2 seperate Debt Collection Companies in contact with me via post threatening to commence legal proceedings to recover sums if i dont make immediate payments. I acknowledge the debts but am not in a financal position where i can make immediate payments to bring the arrears up to date and then as requested set up monthly Direct Debits. If i was to start paying monthly again it would only be a small amount so i would never reduce the debt due to the interest, where do i stand with asking for the interest stopped ? This would allow me to start repayments and actually start to reduce the debt any help would be VERY much appreciated
  18. thanks DX, just a quick question. I've looked at my Credit Report on Noddle and the Lender against the debt is listed as Santander Cards UK (Top Man) and not Scotcall who not mentioned anywhere. Does that mean that the debt hasn't been sold onto Scotcall, so if i write for information such as CCA etc should i be sending this to Santander rather than Scotcall ?
  19. ok thanks sidewinder...firstly i am going to write to Scotcall requesting that all future correspondence is via post taking on board your advice above. The original creditor is listed on my credit report as Santander Group (TopMan) but has no mention of Scotcall so i will then follow up with another letter to Scotcall requesting more information on who owns the debt etc before deciding my next step. My only concern is that Scotcall havn't given me any indication of a reference number or account number to quote when i make contact so hopefully my name and address will be enough info to start with.
  20. ok i've looked on Noddle and account was originally opened in February 2004, the last payment made was in December 2010. Payment history only goes back until 2006 though. Like i thought the majority of this debt must be interest as i havn't used the store card in at least 5-6 years, the report shows i made over £180 in payments in 2009 alone, and i'd be very suprised if i ever made more than £250 total in purchases. I remember going into the store to buy shoes originally and being persuaded to take a store card when i had the money to pay for them outright..... ..what an idiot but you learn from your mistakes. To be honest there is noway i can afford the £806 they want and out of principle i dont want to pay that much for a pair of shoes and a few shirts, especially when i've probably already paid the original amount 2 times over
  21. Thats great, i will take your advice which is very much appreciated. In the meantime is it best to print the doorstop caller note that Brig posted to give it to him in person when he next calls or should i send via recorded delivery to their offices ? (Some advice that i've seen says never to make contact with them). That will make us feel alot better, its a horrible feeling knowing that this clown could turn up any minute on any day
  22. Thankyou for your quick reply, the card handed to my wife was in a brown envelope. I havn't made any payments for approx 2-3 years. They've been trying to phone me for ages but because it was a voice recording and i didn't know what it was regarding i ignored the them. How do i go about checking my credit files ? What is the worst scenario here, could they take me to court ?
  23. i think the account must be between 5 and 7 years old and i know i havn't made a payment for at least 2-3 years, there is a chance i still owe on this account but my guess is the majority of the balance due is late payment charges and interest after all the original credit limit was only £300. I am thinking of sending them the letter telling them not to turn up at my house as its against OFT Guidelines and will and include your advice above. Shall i ask them to prove that they have the legal right to chase this debt ? (request a cca) thanks very much for your reply
