Thanks for your help.

 

I was discharged within 9 months and yes it was included in the bankruptcy.

 

After speaking to Equifax and Experian they tell me I have to take it up with the companies concerned who will then tell the three credit companies. Should be an old man when that happens.

Ok place a notice of dispute on all CRAs showing the data, then a formal complaint to the Data Controller at both companies as follows.

Same letter to both area marked xx fill in relevant details.

 

Ref:xxxxxxxxxxx

 

Formal Complaint.

 

 

Dear Sir or Madam,

 

I have recently checked my credit reference files held by xxxx & xxxx credit reference agencies and have found that xxx xxx account is still showing on these files despite being

subject to Bankruptsy on xxxxxxx and discharge on xx xx xxxx as you are well aware this entry in no longer pertinent and must be removed fortwith I now expect this entry to be removed.

 

Failure to remove said entry will result in a complaint to the Information Commissioners Office with out further refence to your company.

 

Send RD check receipt.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

What happens if a creditor refuses to update to date of BR & insists on using date of discharge for CRA's ?

 

Every creditor on my file shows partial/satisfied as BR date except for Provident who insist they are correct to use discharge date so my file is trashed for 7 years post-BR, not 6 :mad2:

I've seen it reported both ways, may be worth a query to the ICO and/or the insolvency service.
