    • The last photo shows the overflow carpark looking at the block which our room was located. When we got out of the car my partner thought that the building was for staff accommodation.  The unsecured bedroom window opened onto this car park.
    • Also I see that you are doing a lot of this on the telephone – and without any written confirmation. This is a big mistake. You need to start taking this matter seriously and so everything should go in writing. If you have telephone calls then they should normally be recorded. Read our customer services guide. You should make notes about every telephone call and then you should send an email to your telephone correspondence confirming what they have said or what they have agreed. It is important that you keep detailed paper trails here. Of course we may be jumping the gun and maybe big motoring world will step up to the mark – but I'm afraid that they have a lousy reputation has you have seen and so you need to start practising survival techniques and protecting yourself. You say for instance in your letter of rejection that the mechanic told you on the telephone that the gearbox needed replacing. Do you have any other evidence of this conversation? This is going to sound a bit harsh – but other people will be visiting this thread as well for their own purposes. You conducted their research about this company before you bought the vehicle. You now are fully aware that this is a company which can be very difficult to deal with and causes a lot of problems for many of their customers and yet you are still taking a telephone/verbal approach. Do I need to say any more? Also one of the documents you put up is an email exchange but it is not clear who is writing to who or what dates. If you showed this email to somebody in a pub they would be asking lots of questions about who sent the first message, who sent the second message, what dates were they sent et cetera. Please think about this before you post things. Please can you clarify the details of that email exchange. Please will you present the information carefully. We are all volunteers here and we have to rely on you to do the spadework
    • I told the DM that the room was not acceptable because of the reasons already mentioned. He informed me that they were full that night and that they could move me to the room next door (would not solve my problem with the rooms location). Told the DM that I could not stay in the room provided for the night so left no option but to leave. DM did not reply and I walked out.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I please need some advice if possible.

 

Last Saturday I received a letter from the Jobcentreplus stating my Employment & Support Allowance Contribution Based (ESA - C) has been stopped due to the 365 day limit. I started receiving this benefit last December after switching from Incapacity Benefit.

 

My query is this.

 

This is the first time I have heard this benefit has been stopped. Is there some kind of notice period? I haven't received ANY notification that the benefit is going to stop, it has simply stopped! It couldn't have happened at a worse time as the kid's are going back to school next week, all my Direct Debits are due and we need food shopping. I am having to sell an old car I had on the drive which I was keeping for when I return to work just to survive the next couple of weeks.

 

After speaking with the Jobcentre they said they would send form ESA 3? No indication as to what this is. Is it a reassessment form does anyone know? Do I need any Dr's certificates or anything like that? What a mess.

 

Also my wife is thinking of claiming Carer's Allowance for my Father. Does anyone know if Carer's Allowance will affect my Claim for ESA Income related?

Hello and welcome to CAG.

 

I'm not one of the forum experts, but I think this could be connected with income-based ESA and I have a feeling that it's paid for 365 days now before you're switched over. You could check that on the directgov website.

 

But I agree they shouldn't have just left you. I expect the guys will have helpful comments for you, but it might be worth another call to JCP when you have a bit more information.

The government has limited the period for which contribution-based Employment and Support Allowance (ESA) can be paid in some circumstances. These changes came into effect on 1 May 2012. Claimants who have already received 365 days of contribution-based ESA saw their entitlement end on 30 April 2012.

What are the changes?

 

Welfare Reform Act

 

These changes are part of the Welfare Reform Act and started on 1 May 2012

 

 

The changes will:

 

  • limit the amount of time people in the Work-Related Activity Group (ie those not in the Support Group) can receive contribution-based Employment Support Allowance to 365 days, and
  • remove the special contribution condition and prevent any new claims for ESA on grounds of youth.

If you are receiving contribution-based Employment and Support Allowance and your benefit is time-limited you may be able to get income-related Employment Support Allowance. This will depend on your income and savings. The DWP will tell you how to be assessed for this when it contacts you to tell you that your benefit is ending. If you qualify for this it will be paid as soon as your contribution-based benefit ends.

Thanks for the information. It all helps. It seems to be a case where I can change to ESA Income related. It's so darn frustrating that they can just stop all income without any notice lol. If I had known maybe I could have applied for the other benefit earlier.

 

Anyway I appreciate your time and effort in helping me. Also I noticed on their website that if my wife were to work more than 24 hours I am unable to claim ESA Income related. Do you or anybody else know if she were to claim Carer's Allowance would that count as working or working the 24hrs needed to disqualify my claim for ESA Income Related? Dam, benefits are soooo confusing! All being good very early next year I will be back in work again, thank goodness.

If your wife was to receive carer's allowance, they would reduce the Income based ESA by the amount of the carer's allowance, and then add an additional amount called a carer's premium onto your ESA - so you end up with a net gain.

I did have an answer that may also help on this forum. My question about whether Carer's Allowance will count as the 24 hours work my wife can do whilst claiming ESA (Income Related) is no. You can Claim Carer's Allowance and it doesn't effect the 24 hour rule.

 

As the last poster said though there's an upside and downside but the upside seems better!

If you claim ESA IB and your wifes claims CA and she does some partime work, true she can earn up to £100 and still claim the CA,

 

but as abc123def has said her earnings from that part time work will be taken in pound for pound against your ESA after a twenty pound disregard has been applied.

So eg your wife earns £80 then £60 would be deducted from your ESA..

 

CA is grounds for I.S but the same rules apply in relation to part time earnings
