Hi there - I wonder if anyone can help.

 

Freds have sent a bunch of 'statements' from a Mint card in response to a prove-it letter.

 

Now, I may have the wrong end of the stick here, but statements don't give proof of a credit agreement, nor do they prove that I specifically hold the debt, is that correct?

 

This is a debt that dos'nt appear on my credit file either, so I'm guessing they still have a way to go to prove anything here.

Hi Bird,

 

For a copy of the Credit Agreement, you need to send Fred's a CCA request, template for a CCA request is here... http://www.consumeractiongroup.co.uk/forum/content.php?414-CCA-request-letter

Enclose a £1 Postal Order, send via recorded delivery so you have a paper-trail.

Fred's have 12 + 2 working days to respond.

 

Is their any PPI and/or charges on the Mint card? If so get reclaiming, unless you have all of the statements, you will need to SAR Mint, Enclose £10 Postal Order and you should have everything back within 40 calender days.

DO NOT use a claims Company when you can do it yourself for free!

There's a whole bunch of overdate charges in the statements I've received from Mint, so I'll start claiming them now. I reclaimed a whole bunch of PPI a couple of years back so it's very familier to me - unfortunatly I did'nt get PPI on this otherwise there would be another nice fat wodge.

 

Freds have sent a credit agreement, but I'm really puzzled as to why the debt dosn't appear in my credit report. I stopped paying a couple of years ago as I could not afford it, and asked the previous holder of the debt to reduce my monthly payments - this was a couple of years ago and they never did anything about it (I was not a cagger then, otherwise I would have told them to shove it.) I wonder if the fact that they ignored a hardship request like that means it becomes a bad debt, or uncollectable? Does anyone else know anything about the law in this area? I may SAR the previous collection agency I had the agreement with for their documents whilst I'm here,

Hi,

 

Don't forget to add interest onto them charges that you are claiming.

 

If Fred's have sent you a Credit Agreement, Is it enforceable?

Please scan in, remove all of your personal details including barcodes, reference numbers etc.

 

This is DX's instructions to scan and post documents, someone will then check on the enforceability of the agreement...

 

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

the hit reply button

 

As to sending the previous DCA a S.A.R. - please be aware that alll they will hold is very limited information and for your tenner you will receive a couple of A4 pages at most.
