Hi first post please help I have a property I have owned for 12 years and was made into to flats the gable wall had to be demolished and the property lay empty for 7years I had to move in 5 years ago and and have been making do with the small part I could make for my family so I'm now making the place into 1 house and have received a bill from the council for 12 years council tax for one of the flats can they do this ?

I've moved this thread to the appropriate Forum.

 

I'd think if you've stayed in the flat for the past 5 years you'd be liable for that.

 

Regarding the major repairs or alterations being the reason for you not staying in the house, you can be exempt from paying the council tax for one year after the last day that you stayed in the property.

 

It's not something I'm all that clued up on but will have a look around, see if I can help any more.

Found a bit more info..............

 

Some property is exempt from council tax altogether. It may be exempt for only a short period, for example, six months, or indefinitely. It may be exempt because of who lives in it.

 

Properties which are exempt include:-

 

Property which is empty. This means it has to be unoccupied and unfurnished. The exemption applies for a maximum of six months and the property has to be vacant for the whole of this period (although up to six weeks of occupation during the period is allowed). Local authorities can offer an empty homes discount of up to 50 per cent on unoccupied and substantially unfurnished properties which have been empty and unfurnished for more than six months

 

Property which is vacant because it needs major repairs or alterations to make it habitable. The exemption applies for a maximum of 12 months whether the work is actually finished or not by then.

 

Looks like you would not have to pay the other 7 years at full price but at a discount, think you'd have to get in touch with the council for advice.

hi all

I have a major council tax problem and they are asking me for 12 years tax

 

this is a bit of a long story i feel i may need the help of a legal aid lawyer does

 

anyone know do any of these guys specialise in council tax thanks to all
