Hello,

My partner has recently recieved a factually inept and incorrect letter from her ex husbands solicitor. In the letter it is addressed to her former married name and not her now maiden name. The divorce was signed and sealed in Feb 12. Does this make the letter invalid?

 

I wondered what people would suggest to do with it?

Many thanks for your reply.

 

It is regarding the sale of the former matrimonial home and the progress of the sale. He has made some wild accusations and assumptions that are not based on fact of which we have documented proof. I just wondered if the fact that this is addressed to her married name which is clearly not her name anymore makes this letter worthless.

 

The letter also contained stipulations and conditions that were never in the original divorce agreement that both of them signed. I wondered where she would possibly stand on this?

I assume your partner has a Solicitor to convey the proceedings.The fact that they use her married name would bear no consequences with relation to the disposal of the former matrimonial home because that was her name in relation to the Mortgage and Land Registry.

 

If its in view of things to be agreed re settlement then her solicitor will advise which name should be referred to for future purposes.
