webb resolutions resposession issues and 22k in charges

i need help please or advice ! to start off im reading the all familar tale about webb resolutions destroying lives. as per they have done to myself.

 

after our mortgage with mortgages plc was sold off to webb resolutions, arrear free but did have some in the past..

 

i then lost my own retail business due to the credit crench from 2009 until 2012 it has been a nightmare.

 

after having arrears of £1800 along with a suspended order the judge awarded possession unless i made within 72 hours - a long with it being a firday at 2 pm i had little or no chance

 

webb resolutions refused offers of £104 in full to clear the mortgage and the rest of the amount owed is in legal fees and charges was 22k ,

 

im bewildered by this amount and since they will not comunicate with me im feeling very lost indeed..

. they went to court with 3 solicitors against my one.

. we lost because webbs representatives not would allow us to get a word in edge ways

and everytime we started to explain something they had a ready made legality to fight back with.. no common snese nor morals.

 

i then found my home for sale at £10k under the asking price which i felt was ok considering.

i have then found out today they have accpeted an offer of £120k.

. this is not in my best interests as the mortgage still had some equirty in it given the right selling price.

 

i also feel and im sure as well that webb resolutions have acted incorrectly

but i really need help and a good legal firm to do this.

funds i dont have right now.

 

i would also like to try and get my home back. it has new kitchen , bathroom etc and its my world

- my life feels its been ripped out of me and im falling apart with a little hope i can do something to stop the sale urgently and fight this via the courts.

 

also web resoultions offered a help to sell scheme working with you in order to sell,

this was not offered to me even though i did ask for this option they wanted to reposess me regardless.

 

they are not regulated either and its a huge worry for me fight a firm like this who show such aggression in dealing with human beings.

again i stress my arrears were £1800, hardly £10k -- they have so far destoyed my life and im now homeless litrally with no roof over my head.

 

they have caused me huge anxiety and worry and but i unless i get some action again them my world is going to fall apart and so i am.

i genuinely need help as i believe i should be able to get my home back or prevent the sale for now.

Do you have a concise list of all the charges ? Have you asked them to refund you ?....if they have refused then you could open a case with the FOS possibly or take them to court for the excessive charges...

webb refused to refund any charges at all. i know one for a fact some are incorrect etc but the y refuse to acknowledge this.

 

they have also tried to sell my home under value by a mile..we own family offered to buy the mortgage / property but they wanted 128k

webb they go and accept 119k from a stranger.

 

im frankly at my wits ends, homeless now and feeling very low. they have ripped me off and claimed on friday 29th june they did not want to evict me for arrears of £1798. then why in court did they take 3 legal representatives and refused a lump sum payment of £1000 there and then.. they are the the ultimate in liars and being deceitful.

 

ive no home, no where to live and cant see myself surviving much longer.... they clearly didnt want to help but im powerless now.

 

what can i do.. can i get it back into court and see if i can get my home back?

im now so depressed and the thoughts running through head are not good and im scared. my own family will not help me get into a rented flat which the goverment would pay once im in.. im truly a lost soul and dont see a way out..

 

the 35k equity i had i will now get none as they have charged me nearly 24,000 in fees now and sold my property 25 under value...

 

they have left me with nothing. not a £1

As 42man says you should go for these charges back.Filing a complaint with the FOS will not affect secondary Court action so you could do both.

You need to be advising them in writing that you will do this.

If they wont agree then ask them to put it in writing.

They have a duty to respond as holders of a CC licence.Ask them also for a copy of their complaints procedure which they must send.

The FOS are likely to want to see they are ignoring you or else copies of anything they have sent.

Webb resolutions are not members of the Fsa etc

they have to get other companies to do their administration which is perfectly legal but the aggressiands gown and Tatics used show thry only want your property as it is a private company of investors. so helping the mortgagee isn't on there agenda. they even offer on the Webb site the option of we will help u sell etc. they clearly didn't offer me this. and and every opportunity got me into court at 2 k a pop. the stress and worry is litrally gonna give me a heart attack , already had to visit the doctors on several occasions

 

I want to get an injunction to stop the sale and then I will raise a court hearing about the mortgage repossession

they refuse to budge on the fees charged and they know if this is looked at in depth they will have the repossession pulled and my home given back

 

I'm just running of time and seem to be getting no proper help in the matter which is making it twice as hard.

 

Webb resolutions ate trying to get a sale down now and I need to stop it before its too late

Just because they aren't FSA registered then it doesn't mean you can't open a case with the FOS (I think / hope you already know this).

 

Have you actually asked them to refund the charges ?

I'm surprised the judge gave possession over £1800 arrears. What payment proposal did you offer at the hearing? i.e. how much per month to clear the arrears

good afternoon

 

i wrote to webb and verbaly over the phone they offer to deduct £200.. what a joke they are.

 

the fact that there are fees on there that shouldnt be webb just brush over it..

. they have ruined my life over £1798.

. i had a solicitor representing me that was a waste of time.

. as it was suspended order i can only summise that went well against me.

. webb on monday july 2nd said on the phone

"we didnt want to evict -we wanted to help you "

 

so it beggers belief why they refused every offer and options to work with me.

.. they never wanted to work with me

 

..im homeless,broke and have been stiched up like a kipper by webb resolutions..

 

.i begged and begged them and they said we can let you have your home back for 125k..

strange how they then sold it behind me back for 120k..

 

.. they are just nasty nasty people and they dont realise the damage it has done to myself and and family in the process...

totally ruined my relationship with my family.

 

no help from anyone.

..cant get re housed either.

. 3 months of this now and frankly and my wits end

- depression beginning to set in

 

..anxiety attacks and panic attacks now.

 

im just gobsmacked and over whelmed after working all my life it has come to this.

.never have i claimed a penny off the goverment and when you go to them for help they tell you sorry we cant help.

. my self esteem has taken a battering like never before.

we offered £150 per month or 14 days to clear in full..

they had 3 solicitors who all declained.

. demanding payment between the friday 2pm and tuesday 9am.

. i simply didnt have enough time

..i still believe now they acted unlawfully

 

.. eg.. they are not allowed to issue proceeedings as they are not regualted to carry out the duty

..hence it should have been lapitus or crown from what im told who should issued proceeding

.. something isnt right i know that much,.

 

theres a whole bunch of issues and questions they refuse to answer

and then to top it off sold my home behind me back whilst in negotiations to buy it back.

 

. they took the lower offer from a complete stanger after telling me it ok to but it back.

 

.. they are liars,decietful and the lowest of the low.

 

the markets it for 3 weeks at 130k then took 120k 25 under asking price and clearly not in my interest..

I have just been back into court for the 10th time and 17 suspended possession orders,

 

in short I have been fighting webb for the past 3yrs. I had a solicitor and barrister come from london for Webb who sat and said nothing at all but will cost me £600, I have £15,000 in arrears and £16000 in fees, I have 18yrs left on my mortgage and as long as you offer a reasonable amount over the rest of the mortgage term to complete the arrears a judge should always back you rather than eviction and you should be able to prove you can do this. I never speak to Webb over the phone, I always email because over the years I have learnt they just lie, you need to keep a diary and proof in full of what you write to them or send them, email is great they say they wont accept email but it does stand up in court and they always write back in letter form. If you send a letter record it, they arnt registered with the fsa and the fsa wont look at your case but will deal with there administrators and that who you base the complaint over. I am now going back to the ombudsman and the fsa with the outrageous way Webb and Lapithus treat their customers and the charges they apply. I dont have time at this min to go into details but if we can all fight against webb resolutions then people power and the law should be able to do something against this firm that has no morality for human beings only money and profit . Please keep in touch as I am feeling fighting fit and want to work at a way to bring this firm down. I sure there is hundreds off people out there with the same problems happening to them and if we can all work together surely somebody has to listen. Keep Strong, not easy but you are in the right.
