    • Hello All, I was hoping for some help with a  Claim Form received yesterday 15h May 2024.  I have read lots of threads but I just want to check what I am doing. I have acknowledged service noting my intention to defend all of the claim and I have left the contest jurisdiction un-checked. I will today/tomorrow issue a CCA request with a £1 postal order to the claimant and a CPR 31:14 to the solicitor.  For the CCA which section should I use? I am not sure which section Paypal Credit would come under. If the claim was issued on the 9th May am I correct with my defence filing date of the 11th June? Is there anything else I need to do?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

To cut a long story short I have a repayment plan with muck hall which I have stuck to and paid on time. I have a pin to access my account online and make payments and see my statement. On the page that shows my payments they have posted in huge letters that I have now defaulted on the agreement and will be issued a ccj!! And I will be liable for all legal costs!! They have started emailing and texting this aswel. I've been bloody paying them and my reduced balance clearly shows! What are they playing at? Should I just ignore it and carry on paying?

Hi,

Keep everything, emails, screenshots, everything. If they ring you, youcan either refuse the questions or record their drivel

 

Formal complaint to them and to East Ayrshire Trading Standards who have Muck Hall on their radar.

 

This is a complete breach of the debt collection guidance as you are up to date with your payments

Thanks silverfox, I also forgot to mention that they want payment in full. Well they can whistle for it, I have already reduced my debt from £750 to £550, if they are going to start trying to bully me then they will get nothing more and they can take whatever action they like

They can ask for anything they want. Under OFT guidance, they need to come to some arrangement. As silverfox pointed out, theyve already made a HUGE mistake. You just need to take advantage of it.

Thanks, but what I don't understand is why are they doing this? And when you say they need to come to some arrangement, what do you mean? I only ask as I already have a repayment plan which I would assume is already an arrangement? Sorry I'm just gobsmacked by their behaviour

Nobody knows why. Its just how they operate. They think bullying and threatening tactics work. Even though what they are doing is illegal. And yea, i meant an arrangement for a repayment plan.

 

As for your issue, as long as you have a full and complete paper trail, they cant touch you. This can also include bank statements to prove youve paid what you have said.

 

As silverfox rightly said, first thing in the morning, get those complaints sent off and let the relevant agencies deal with them.

Thank you very much, I definately am going to get complaining. I already have proof as my statement on their website shows what the balance was in the beginning and what it is now. I think I shall continue with the monthly payments as normal, then they don't have any extra ammunition, and I am that step closer to paying off the debt with every payment, I can't imagine being liable for legal fees as I haven't done anything wrong

Yep. Keep those repayments going as agreed. It sounds like theyre trying the old trick of inventing an amount then saying you need to pay it. Unfortunately for them, it looks like theyve chosen the wrong person to try it on.

yes I originally had 3 Payday loans that all got passed to DCAs. One of which is now completely paid off which I guess I could also use as back-up if need be. But you know what they say about bullies, just ignore then and carry on as normal, that's the best way to deal with them :-)

Funnily enough they didn't, the amounts always remained the same. They can try what they like, I know what I owe and they will get that back and not a penny piece more. I've just moved house and changed my name as just got married, so once the debts are paid I shall just change my mobile number and email address (keeping all records of my payments) and let them take the time and trouble to find me just so they can add illegal charges to a debt that has been paid

As said above, they can demand what they like - they have been accepting your regular payments and obviously the balance has been reducing - they would have a hard time trying to get a CCJ (they know that but hope you don't)

Completely agree. They use the 'threat' of court proceedings to scare you into paying more or settling the debt.

 

I would be calling their bluff and state that if you think you can get a CCJ, go for it (but that's just me)

Well Would you believe it, I copied trading standards in on an email of complaint to muck hall and they replied within ten minutes apologising and saying there had been a system error and not to worry as my account was not in arrears,and trading standards were copied in on their reply aswel, funny that!

Well Would you believe it, I copied trading standards in on an email of complaint to muck hall and they replied within ten minutes apologising and saying there had been a system error and not to worry as my account was not in arrears,and trading standards were copied in on their reply aswel, funny that!

 

 

Yeah Right!

A system error is usually caused by some pillock pressing the wrong (right?) buttons. These companies will always blame a system error when they get caught with their pants down

Alan Stewart and Sam Gardiner are the two bods who deal with Mucky Hall at East Ayrshire Trading Standards, it was Mr Stewart who listened to the recording of the idiot from MH who said he could ring me hourly until he was paid xxx - which I didn't even owe!

 

Unfortunately this company seem to escape being closed down, I think it is because they provide jobs in a tough area, but that should not be an excuse for their non-compliance or other offences.

 

System error my foot - they are definately taking the proverbial here!

The person may not be there, Mucky Hall send me 'begging' letters and I just refer them to TS... I am in south-west London UK.

 

I am not sure if Mucky Hall do go for CCJs, or who they 'use' to do them but they usually huff and puff and go away once threatened.
