    • So, Sunak has managed to get someone to 'volunteer to go to Rwanda hasn't he? .. for just £3000 payment to the person plus 5 years free board and lodging isnt it? - cost to UK taxpayer over £300M+ (300 million quid+) isnt it? - Bargain says Rwanda, especially with all the profit we made privately selling those luxury chalets Bravermann advertised for us   I wonder how many brits would jump at that offer? Thousands? Hundreds of thousands? Lets see, up to 5 years free board and lodging and £3k in my pocket .. I'd go - and like that person - just come back if/when I get bored. First job - off to Botswana for a week to see the elephants.   Of course the paid volunteers going to Botswana are meaningless - Rwanda have REPEATEDLY said they wont take any forcibly trafficked people in breach of international law eh? Have the poops actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table? Thanks for your help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I stupidly took loans out with lending stream. I then had my hours cut and was unable to pay. I emailed them and asked not present direct debit as it would be rejected. they stil went ahead and made lots of withdraws at midnight for £3.00 even though I owe them £100

 

The bank phoned me and as I did not recognise the amounts put a stop on the card and my account. I have open another account but I am confused what do I do now.

 

Will they agree to a repayment plan over 1 year? Really worried they will start phoning me at work

Hi Janes,I had no calls from LS to my place of work they were one of the ones that didn't call, will probably get long term plan with them though they will try charge you for the privilege, or they use to. Their letters cost £12.00 so if you can avoid default do. I agreed to pay quickly and they wiped £62.00 in additional charges in lieu of quicker settlement and also gave me their bank details. Thanks Lending Stream, can't say anything bad about them as they could have passed me to Mucky Hall.

Forget about their obscene charges per letter. If they want to play that game, tell them that you will charge them double their amount to read them.

Just had a phone conversation with credit resource solutions ltd who are dealing with my lending stream account. I asked them to tell me how had been paid off my account so far. They told me there had been one repayment. I know this is completely wrong because they took 2 different payments without telling me in February.

 

The damning thing about lending stream is they appear to be deducting money from bank accounts and not updating their system. Something is very wrong with this company at the minute.

Stop right there. NEVER EVER EVER talk to them on the phone. They will tell you a bunch of complete crap. As for something being wrong with the company, the whole business of PDL's is wrong. Not just "at the moment". They are purely legal loan sharks who can only exist because they are exploiting a loophole in the law.

 

In regards to payments from your account, if it ever goes before a court, and you can get notarized bank statements, thats all the proof you need.

Hee hee! I'd love to have done that but it was very much damage limitations at the time! and the £12 charge is okay'd apparently by the OFT (which brings me back to systems which fail people)

The £12 may be ok. But then again so is charging them double as an "admin charge" to read and act upon the letters.

Never take out loans from Lending Stream, first they are robbing B's and second every top up loan you take out is recorded as a new loan on your credit file. i had 600 points on experian file before I took out loans and after 9, I was left with less than 100 points- I spoke with experiean and they have said, LS wont tell you this as they want to make the money, that short loanis now recored on my file for 6 years!!!!!as 9 different loans, which looks bad

I have tried to speak with LS, but no one cares, they couldnt give a sh@@ never again will I use these companies, please be aware they are con men

Hi

2 years ago I had severe depression and stupidly got in debt with payday loans. The worst was lending stream. I took out 4 loans with them. One after another mainly to pay back the repayment charges. When I could not pay they used CPA and took money from my account on one night went to bank try to go to my account 44 times to take £5.00 until bank froze account. They left me with no money and had to go without food for 2 days.

I have now complained to the FCO about them. I do not want them to write off the debt and happy to pay back what I borrowed and some interest but what they are asking will take me till I am 105 to pay back, They have now passed to MMF so expecting more and more threats and distress

 

 

Borrowed 200 paid 280 outstanding 326

 

 

Borrowed 300 paid 175 outstanding 768

 

 

Borrowed 215 paid 278 outstanding 289

 

 

Total borrow 715 paid back 733 still outstanding 1383

 

The interest rates on loans is 5387.8% APR

As a foot note to above plea for help. I currently have a debt with Wong taken out 2010 still waiting to hear if they will write off as now with Debt management company. If they do will others also or make my case more complaint more crediable

Why did you have no money for 2 days? Tell your bank to issue a full chargeback as 44 attempts is CLEARLY wrong.

I had no money and it took me a week to ask my family for help

The bank stopped after allowing 5 to go through but told me how many times the attempted to take money

ifthe fos judge in your favour you could always claim the payments back.

 

 

what type of complaint - irresponsible lending?

if so they'll simply wipe the debt with no redress

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
