Aq's are usually served by day 28 post last day of filing defence....... in your case that could be any time between now and 28th February. There's no hard and fast rule though, and in some instances cases can [and do] proceed without a party filing aq. Its early in proceedings and the courts case management powers are wide and varied.

 

If you're concerned you can always give the court a bell. They're all overworked and stressed but remain polite and you may find you brighten someone's day enough that they take the time to guide you through the process.

Also AQs are only served if the Claimant responds and informs the court they wish to proceed,no response no AQ claim stayed.

Not sure what you mean dx?

 

I'm sure I've paid money towards the account, in fact I'm positive I have over the past 6yrs but why wouldn't it be on the credit file?

 

I was told last night that depending which credit reference agency you use, depends on what information is on your account, they could differ! what chance do we have?

 

The account is removed from your Credit file SIX YEARS after the default date registered, if you have made a payment since then the debt can still be legally enforced, it will not appear on your credit file bar a successful CCJ being obtained.

Still no aq, its now day 29, should I just sit tight and see what transpires?

You will need a great deal of patience Gav when you get involved with Litigation.They have 28 days to respond if not the claim is stayed.Then you decide what your next course of action will be.

If its stayed they wont inform you its for you to inquire with the Court.You don't attend court because its stayed (nothing happening temporally shelved)

Gav-have you a NoA from Robinson Way & Co Ltd to Robinson Way & Co 2009 Ltd ( or more likely Robinson Way Ltd) on or around 25/9/09? Does the original have a footer note in bold bearing the incorrect date of assignment? Or do you have a reconstituted copy without the inaccurate footer note and,if so, when is it dated & who are the assignees? I'm going to Trial tomorrow and dependant upon your answers I should be able to supply an interesting update for you that should influence the outcome of your case- I believe you are already aware!
