    • extension? you mean enforcement. after 6yrs its very rare for a judge to allow enforcement. it wont have been sold on, just passed around the various differing trading names the claimant uses.    
    • You believe you have cast iron evidence. However, all they’d have to do to oppose a request for summary judgment is to say “we will be putting forward our own evidence and the evidence from both parties needs to be heard and assessed by a judge” : the bar for summary judgment is set quite high! You believe they don't have evidence but that on its own doesn't mean they wouldn't try! so, its a high risk strategy that leaves you on the hook for their costs if it doesn't work. Let the usual process play out.
    • Ok, I don't necessarily want to re-open my old thread but I've seen a number of such threads with regards to CCJ's and want to ask a fairly general consensus on the subject. My original CCJ is 7 years old now and has had 2/3 owners for the debt over the years since with varying level of contact.  Up to last summer they had attempted a charging order on a shared mortgage I'm named on which I defended that action and tried to negotiate with them to the point they withdrew the charging order application pending negotiations which we never came to an agreement over.  However, after a number of communication I heard nothing back since last Autumn barring an annual generic statement early this year despite multiple messages to them since at the time.  at a loss as to why the sudden loss of response from them. Then something came through from this site at random yesterday whilst out that I can't find now with regards to CCJ's to read over again.  Now here is the thing, I get how CCJ's don't expire as such, but I've been reading through threads and Google since this morning and a little confused.  CCJ's don't expire but can be effectively statute barred after 6 years (when in my case was just before I last heard of the creditor) if they are neither enforced in that time or they apply to the court within the 6 years of issue to extend the CCJ and that after 6 years they can't really without great difficulty or explanation apply for a CCJ extension after of the original CCJ?.  Is this actually correct as I've read various sources on Google and threads that suggest there is something to this?.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just tell me what part of my post is incorrect in any way. Why do people try to gloss around things? Those were the charges laid for working and claiming unemployment benefit, that was the sentence and that is what has happened to him since.

 

Do you honestly think that benefit fraud isn't that serious?

Well its the weekend and as usual the post always without fail brings bad news on a Saturday.

 

The Council will not wait until the Council Appeal has been processed so have issued a Court Summons for arrears of council tax thats now on the 9th of August

 

The DWP have responded to my Incapacity and Income Support Appeals only because my MP wrote to them asking for a response.

 

The DWP telephoned me not long after they received the MP's letter and I can tell you they were not happy bunnies at all !!!!

 

more to report as and when I get it

 

November 2011 this lot started !!

Hello folks

 

Just to update you a little more. Because my MP responded and wrote to the DWP I received two letters one about Income Support and One about Incapacity Benefit. They both stated that my Appeal was under consideration and had been allocated a respective number.

 

This was followed up by a telephone call from a DWP person who spoke very politely and explained that my file had been all round the country and that it was now at Cokebridge ???? in Scotland where the file was being prepared for consideration. They were waiting for more information and it would be perhaps no longer than 3 months before a decision on the next step was to be taken.

 

I have also wrote to the head of our council and copied the Ombudsman in regarding sending me a summons before the outcome of the Appeal I wrote to the Council has been investigated.

 

I did ask the council recovery why this had happened and they just stated it was council policy !

 

So back to the long wait

COATBRIDGE ! I thought she said cokebridge yes indeed it seems that this is one of the many centers around the country where decisions are made. If it is 3 months more then it will be have a long time since November 2011. But I was'nt interviewed under caution until Xmas 2011

Hello folks

 

I wrote the local council and pointed out how could they issue a summons for the council tax when my two appeals had not been adressed.

 

I also copied the letter to the case officer at the Local Government Officer looking at my complaint

 

Result I have today received a letter from the Head of the Revenue at the council stating that they were now looking at my Appeal.

 

Surprise Surprise Surprise its only taken them 6 months !!!!!!!!!!!!!!

 

I am not holding my breath as the court day is looming closer in August

 

 

I will update as and when I get any result

Yes makes a change but I feel its down to me now involving the Ombudsman and my MP

 

They will I am sure try and not loose face and will come back with some punative action

 

also got the approx 3 month wait for the DWP to make a decision

Well seriously bad news today

 

The local council have wrote and said they intend to follow a joint Criminal Prosecution with the DWP The letter from the council was quite dramatic and they pointed out that they are considering my Appeal but it was their intention to push ahead and go for a Criminal Prosecution ASAP

 

I then telephone the lady from the DWP and explained the letter to her. She was quite concerned that she told me three months and she had received no further update that this decision had been changed

 

She asked me to forward the copy of the letter from the Council and that she would escalate this up to her manager.

 

So the noose tightens

 

I will of course be pleading not guilty and requesting the matter to be heard at Crown Court and see what a jury make of it

 

Still cant get legal advice yet though local CAB seem out of their depth and the local welfare rights is only open 1.5 days a week and the waiting list is long

Hello Folks

 

Just heard that my DWP Appeal submission has all been received at the decision makers at Cokebridge as part was missing so it could be up to three months before I hear again

 

Meanwhile the Council intend to press on regardless with their prosecution but keep telling me its a joint prosecution but the DWP say not at the minute as its not reached any conclusion

 

The local council have been malicious and vindictive which is why I was left with no other place to go other than the Local Ombudsman which helped to get some answers but seems to have incenced certain members of the Council

 

I will keep you informed as it trundles along

Well its Friday so bad letter day

 

The council have wrote and stated formally that they intend to issue a Magistrates Summons for me to be dealt with at magistrates Court despite my Appeal NOT being completed

 

So have to wait for summons

 

I am still waiting to see which way the DWP are going to proceed

Hi folks

 

Forget to say the council have already issued a summons for a liability order for the £600 outstanding including court fee of £70.00 and this is on the 9th of Agust.

 

The total amount alleged by them to have been overpaid by the council to me was over £2,500 in a six year period. All that is left is the £600.00.

 

They are alleging in letter that I failed to " promptly notify a change of circumstance "

To me what you say is absolutly correct however it seems the Council have jumped first unless they have had direction from DWP but then that would be against what the DWP had written in the letters to me and my MP

 

The Council have also decided to prosecute even though my Appeal has been accepted and is working through their system

 

I think its pure vindictivness as I refused to lay down and also made a complaint which is being investigated by the Local Governemnt Ombudsman

Just telephoned council and asked why they are proceeding to Court without the Appeal being concluded and the reply was

 

" Because we can and if the Appeal results in your favour we will withdraw from Court action "
