Can I just say this is my first time on here and have been reading on the forum for the last 5 hours and Im going to start my claim asap and I feel much better taking on the Bankers knowing that all you peps are here to help and thanks for the best read Ive had in a while and waiting like the rest for the end on whizzkids story8)

However in light of these successes should we really be concerned about going over the £5K limit if indeed these are the real figures and I suspect mine might be !!

 

Surely the real big advantage is that there has to be full disclosure under Fast Track which it seems is a BIG no no as far as the banks are concerned and therefore they may even settle quicker :rolleyes: In fact were you not being nudged in that direction by the judge ?

 

I know that costs can be awarded if you lose but what chance is there of that particuarly in light of these recent and all the other victories...has anyone lost yet?

Technically you have a point.

 

However, the banks are looking for the technicality that can put all these claims to bed. My honest answer is to follow the tried and tested procedures outlined on the site.

 

Slow and even boring perhaps, but it does get results...even if it is as tortuous as Whizzy and Neil's claims...

Firstly , Well done you!!

I sent my initial request for DPA on 3rd june after being inspired by ballsy people such as yourself,Honestly though, I'm petrified by the prospect!

Have just had the standard blah blah microfiche letter and am now responding with the microfiche letter from this site.

I have been inspired by yourself and NeilP's epic battle and admire your cahuna's(think thats how its spelt)

On your thread dated 11th June you mentioned submitting details of other cases against Abbey, my question is where and how did you get this info?--Did you make lists form the details on this site?

top draw whizz,well don and congrats. Last time I read this thread you were waiting for the set aside hearing, and I was losing the will to continue with my claim, however you have spurred me on no end and I'm sending my lba tomorrow!

Their latest delaying tactic of the "set aside" was until now uncharted territory. You are a true pioneer and I suspect enemy No 1 of the banks....lol

Indeed.

 

I see additional issues with fast track. The key one is that this court is not as open to those who represent themselves (unless you're a lawyer). There is a reasonable chance that any half decent barrister will be able to run rings around most of us and quash any claim.

 

In such an event, if the legal costs of the defendant are awarded, there's a good chance that you'll be more than double the amount out of pocket.

 

Jezz, can you imagine having to crawl to Abbey to get a loan to pay thier legal fees? :D

Abbey - Won DPA Claim - Aug 06 and got bailiffs in to recover my court costs of just £30.00

Abbey - Won Charges Refund of £1050 - Nov 06

Egg - Recovered £220 due to Customer Services misinformation - Feb 2007

Nat West - Prelinimary Letter to recover on Credit Card charges £30.00 sent March 2006. £25.40 offered - rejected and the bank reckons that this is it's last word on the matter. We'll see if that's still the case when it reads my N1 form sent recently. It has until the 17th April to respond or the N1 will be submitted.

Like many others I have been stuck infront of my computer reading this thread til the sweet sweet end! I am just about to send my 'letter before action' to the Abbey so here goes...

 

Made me laugh that they said in their Sun interview that people only incur charges if they don't contact Abbey...I contacted them and they told me it was all my fault and the only thing they could do to 'help' was for me to cancel my direct debits and hand in my cash card and cheque book until I'd paid them back. I asked how they thought I'd be able to even put food on the table if I did that considering my wages are paid in that account and if they had my cash card I wouldn't be able to get any money to feed myself, let alone all the companies I have direct debits with would blacklist me! They said that was all they could offer and the next month slapped £500 of charges on my account!

 

Whizzy - I may be asking your advice further down the line!!!

Have only found bit on Sun online about Alliance & Leicester closing all accounts of customers who have claimed back their charges, cheeky g--ts - is this anything to do with your story?

7th June mcol £30 + 276.00 + int17.37=£323.37 Abbey

Accepted £291 chq cleared 28th July

7th June mcol £120 + 1135.02 charges + 83.42 chq for £1438.44 paid to bank 2nd Aug

Complain and we'll close your account, says bank

Alliance & Leicester (A&L) is to close the accounts of customers who sue it claiming that the bank's charges are unfair. A&L revealed that the accounts of people taking the bank to court over how much it charges for going overdrawn will be given 30 days notice before their account is shut down. The BBC reports that in a letter sent to customers who have made a legal claim, A&L says: "As it is clear that you do not accept certain aspects of the terms and conditions for the operation of your account, we regret that we are unable to continue to offer you banking facilities." A&L's action follows figures showing the number of people taking their bank to court regarding overdraft fees has risen in recent months. The decision does not break UK banking rules.
