  1. you summed it up entirely...they settle once it reaches a certain stage (aka the last hour before court date) and i think it's cos they hope we'll chicken out of going through with the hearing and drop the claim...
  2. hey rob, yeah abbey will just need to do a list too, though wasn't it johnny2bad who listed what his bank had sent him and it was pitiful reading - such as a leaflet on some completely random thing! don't panick about not hearing anything yet...when's your court date? if you don't hear anything about three days before your court date you could ring them and remind them you're happy to settle privately for the full amount plus court costs, plus interest. they didn't contact me to settle until exactly a week before we were due in court. you could count on your hand the amount of times they've actually attended court and even then it was a rep - not a full out legal dude - see whizkids thread in settled.

  4. hey rob - from reading the guide you got sent by the judge yes it is a list you supply and take the documents to court with you - one copy for you, one for abbey and one for judge (you have file with originals in) maybe there're doing that to save on them receiving loadsa files of court bundles when most cases don't actually get to court? most of the examples in karnevil's bundle are mentioned in the case examples i sent to you. if any aren't there that you wanna look up the easiest way is google. usually be just typing 'name v name' it comes up

  7. hi, abbey didn't send me a copy of their AQ (as they're not required to do so) and from what I gather the vast majority of other people on here haven't been sent a copy either so chances are you won't know. If you're really keen you could request they send it to you, but I'm guessing they're within their rights to say they don't need to (petty, but we all know what Abbey are like!!!)

  9. don't worry about not sending them a copy - if they're that bothered they'll request one and you're not required to send one to them only to the courts - why pay out more on postage than you have to!!!

  11. hmmm...you gotta watch those sneaky shabbey peeps...just chased them up for the outstanding amount (main bulk paid but their figure differed from mine by about £20). Was given a big spiel on how they would only pay interest up to the point of writing the cheque, so I explained once again that it was entirely Abbey's, DLA Piper's and the new solicitors fault that they did not have up to date contact details for me so I did not know they wanted to settle until a week after cheque was written so I expected interest until then. I also explained the original cheque did not include my refund of the DLA letter fee so was given another spiel on how they were not required by law to refund it. I then explained I would not have had to send that letter had they not charged me illegally so it was not a cost I should have to incur from my own pocket and I had clearly stated on it that I was going to claim it back. Was then told that it was not usual to pay it back, especially as in the Small Claims Court I would be expected to pay my court fee out my own pocket and not claim it back so I should basically be grateful they were refunding me that - does this guy think I'm stupid??? If I wasn't entitled to my Court fee back, why does MoneyClaim online automatically include it in your claim amount! Another cheque is now on its way to me for the remaining amount, with a promise from me to cancel the new court date once it has cleared! Guy was friendly enough, but did hope I was clueless me thinks!
