Help needed with capital one credit card

I have a capital one credit card, which for 4 months they didnt have a payment from myself, then on checking my credit history with checkmyfile.com i have been shocked to see that i have a default notice on the 5th month.

 

Firstly i havent receive a default notice ever from capital one and secondly i thought it was on the 6th missed payment you receive a default?

 

This debt is now passed to a debt collection agency who advise that once the arrears is cleared the debt will be passed back to capital one. Which i am now paying £50 a month

 

Please can somebody advise

Sorry, where did you get the idea that they only defaulted you after the 6th missed payment ?

 

A default marker will be entered on your credit files if you have failed to remedy the breach.. ie pay the arrears, that were demanded by a Default Notice issued under s87(1) of the CCA1974. The creditor can issue a Default Notice after just 3 missed payments.

 

You say that you havent received a default notice from Capital One?

Sorry that was what i was told with capital one?

 

But after speaking to the debt collection agency they advise i made a payment in June and August and September

 

Also i have never received a default notice at any time from capital one

So did they tell you this in a telephone conversation or in writing.

im in a repayment plan with the debt collection agency, and i was wrong i have to clear the balance down to £0 and then the account gets closed!

 

I have never been told on the phone or by letter, i only found out by checking my credit report online today!
