    • In the earlier thread (now linked above) you were going to change your name by Deed Poll. Did you do that? Did it solve any of your problems? What, exactly, have you been charged with? Has a court date been scheduled? I cannot think of any reason why the police would tell you to pay your Ex's debts that she incurred 5 years before you met her. Either there's lots of the story you aren't telling us, or you have misunderstood what you have been told, or you are trolling us. Earlier you said it was your Ex who wanted you to pay her debts and, for some reason that  no-one here could understand, you were going to do so. So your Ex can give you all the details of her debts and you can pay them. She can hardly expect you to pay them if she won't give you the account details! I've never known debt collectors be fussy about who pays as long as someone does. They routinely take payments from friends and family to clear debts. It's not illegal to pay someone else's debts

    • it is NOT A FINE.....this is an extremely important point to understand no-one bar a magistrate in a magistrates criminal court can ever fine anyone for anything. Private Parking Tickets (speculative invoices) are NOT a criminal matter, merely a speculative contractual Civil matter hence they can only try a speculative monetary claim via the civil county court system (which is no more a legal powers matter than what any member of Joe Public can do). Until/unless they do raise a county court claim a CCJ and win, there are not ANY enforcement powers they can undertake other than using a DCA, whom are legally powerless and are not BAILIFFS. Penalty Charge Notices issued by local authorities etc were decriminalised years ago - meaning they no longer can progress a claim to the magistrates court to enforce, but go directly to legal enforcement via a real BAILIFF themselves. 10'000 of people waste £m's paying private parking companies because they think they are FINES...and the media do not help either. the more people read the above the less income this shark industry get. where your post said fine it now says charge dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Wondering if anyone experiencing delay in paying out by Lloyds when they have upheld complaint and given acceptable refund offer.

They just met the 16 week FOS deadline in August, stating my complaint had been upheld, I heard nothing further until September (a month later) giving me an acceptable figure, but here I am yet another month later with no sign of payment.

Any suggestions on whom to contact to get them moving on handing over the money, they sure appear to be very reluctant to let go of it.

I think they are required to pay you within 4 weeks of receiving the signed acceptance form. Drop them a short note asking where your money is :)

I noticed on another thread that there are delays with Lloyds payouts because there is a problem in that some claimants have been getting the wrong amount!

 

How many more excuses can these outfits come up with to withold payment.

 

Wouldn't it be nice to send them a "Late Payment" charge of £25?

So are they paying out too much or too little? Is it very worrying that a bank cant get their figures correct :lol:

I have had trouble with Lloyds, basically claimed mis sold PPI 2 years ago and they upheld, problem was there calculations and mine were quite a bit different, some £2.5 k diff!!!!. I re did all of the calculations myself which included re constructing the loan without the insurance (god it took me ages!). I complained again as i wanted a comprehensive breakdown of their calc, they just said it was correct and would not provide me any detail even though i sent my detailed calculations. I asked them to comment on mine which they have not so it is now with FOS waiting in the pile alon with many thousands of others. I would imagine i am not the only one who feels Lloyds calcs are incorrect. I think it's disgusting that they quote ours is in line with FOS methods when clearly it is not, they need to be named and shamed yet again...... I'll let you know how i get on eventually.

I am still waiting patiiently (not) for Lloyds TSB to pay me what is rightly mine. Sixteen weeks have now past since receiving their calculation letter on a paid up loan, this is no joke. Unbelieveable it can take so long for a payment to be made when all they have to do is hand over the cash. I have sent numerous emails and letters (one even by recorded delivery) but they have not even had the courtesy to acknowledge any, I am just about at the end of my tether.

They took 3 months to pay me.

I have come to the conclusion that Lloyds will need a sharp nudge before they pay up and have decided to issue a County Court Summons. I presume this will be issued to their Registered Office , Gresham Street, London and would appreciate confirmation that this is the address to use ?

Update on the present position. I sent a recorded delivery letter to Customer Services and a copy to CEO on Monday stating I will issue a Couny Court Summons if my refund is not paid within 7 days. Today I received letter from Customer Services apologising for the delay in the refund being completed and an additional interest payment being added to ensure the final refund amount reflects the date in which I will receive payment. However there is no mention of when this refund will take place, and no mention of my letter to them on 9 January, in fact this is the only correspondence I have received since their offer dated 16 September 2011.

I conclude I am no further forward, and would appreciate advice

Hi

 

You have two choices.

 

1 -> You issue proceedings after the 7 days are up as allowed in the lba. This way you take control.

 

2-> You back off and wait it out in which case they remain in control.

You have advised that you will take action on a certain date if they have not refunded you within 7 days.

 

You MUST follow through.. they are so used to people making idle threats they simply dont believe them anymore!
