    • If you're set on pursuing the receiver then a complaint to his governing body (if any) might be a sensible low risk first step. You need to confirm what qualifications he actually has. I don't believe an LPA Receiver necessarily needs to be a licensed insolvency practioner, although he may be. Or he may a chartered surveyor. I note you say "LPA" and "fixed charge" receiver, but aren't those two different appointments with different remits? What relevant powers are given in the mortgage terms and security? Or if that's unclear then how was the appointment described to you? Ducking back to the comment I made earlier, you consulted a solicitor who advised a claim against the receiver.     • Thank-you dx, What you have written is certainly helpful to my understanding. The only thing I would say, what I found to be most worrying and led me to start this discussion is, I believe the judge did not merely admonish the defendant in the case in question, but used that point to dismiss the case in the claimants favour. To me, and I don't have your experience or knowledge, that is somewhat troubling. Again, the caveat being that we don't know exactly what went on but I think we can infer the reason for the judgement. Thank-you for your feedback. EDIT: I guess that the case I refer to is only one case and it may never happen again and the strategy not to appeal is still the best strategy even in this event, but I really did find the outcome of that case, not only extremely annoying but also worrying. Let's hope other judges are not quite so narrow minded and don't get fixated on one particular issue as FTMDave alluded to.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all,

 

Im trying to get hold of my Barclaycard account number as i shut the account down and even though i remembered my login to the internet site it only states "account ending in XXXX" So after sending a secure email and then being told to ring customer services i got nowhere. The customer service woman wanted to know what i wanted my account number for etc etc so i eventually told her i needed it to send a S.A.R. and she said she didnt know what one of those was???hmmm yeah right, she even said she could set up a new account for me with a new card etc. hahaha, anyways i now have to write to Barclaycard PO BOX 5592 in Northhampton to get my blimming account number. Why oh why didnt i keep a statement!!:|

Send in the SAR letter along with a copy of proof of identity (passport, driving licence etc) and if you are still residing at the same address a utlity bill.

Well Royal mail showed nothing for Barclaycard but unbeleivably i had a response from them today. They dated the letter 25th Sept 06 so they must be sitting there with letters to go out to everyone.

 

Its the usual microfiche argument, blah blah, nothing before sept 2004. Even though i can get hold of the statements if i pay??:confused:

Trouble is i knew that there would be no info post 2004 as i paid the damn thing off ages ago but i wanted to get the stuff pre 2004 as thats when i paid fees etc. So i cant even assume what i paid based on what they have sent me.

 

Im gonna have to get on with second bit now then. Im assuming thisis the LETTER BEFORE ACTION Section 7 – Data Protection Act 1998 in the templates library?

Ive searched for hours through all the microfiche stuff and my head now hurts! No wonder they put so many people off with this argument.

As expected the letter has been passed to a Carol Jones Cust. relations manager who informed me that copy statements are stored on microfiche etc etc but for £3 a copy statement i can get the info???? Agrhhh, do you think they have a smirk on their faces as they print these letters out?

 

Im not sure what is next now, the letter to the financial obudsman? Problem with me is i closed the account pre 2004 so i cant estimate any charges. Any advice?

yes but the letter won't work as Barclaycard won't give in over this. Better to pay for the statements and then claim the money back when it goes to court.

I have sent them the LBA letter instead closey as suggested in the templates section "Data Protection Act - Non-Compliance - Template Letters" using scenario 1, template 1. and still got the same message re microfische.:x

 

Does anyone know what sort of costs will be involved in paying for copy statements? I mean what are we talking her £3 per page? or monthly statement?:confused:

Ok Non compliance letter was a no go again! Im really considering paying for the statments now. What would 3yrs of statements amount too? any ideas?

 

and again as too strong asked has anyone actually won these costs back?

Im sending off the complaint to the ICO now me thinks, so should i wait for a response from them first or just bow down and pay for the statements?

 

I was hoping the abbey fiche argument might have rattled barclaycard but nope it hasnt!

This gives them a further 7 days before you start court proceedings to get an enforcement order against them.

 

You do win your costs back, however I really wouldn't pay the £3 per statement. You need to show them you mean business.

Finally, got my statements, they sent the usual "we dont agree with the ombudsman" etc etc. Well why did you send them to me then??:confused: also they were a gesture of goodwill :o (about 3 months too late guys!). They were so thorough i got two copies in different posts. Its not for much but im going after the £75 due to the fact they have been so irritating, all my other claims have at least offered me something but not these guys.

Better get on with the claim.:-)

Barclaycard - S.A.R 22/09/06 - Microfishe letter - non com. 29/09/06. - wont comply letter - 16/10/06 16 days left- getting nowhere letter back! 16/11/06 Information Commissioners Office compaint - 18/12/06-Statments sent - prelim going out 24/5/07.

Virgin/MBNA - S.A.R 22/09/06 - part pay accepted - settled.
