Hi -I took out a car finance HP in 2005 for £32000 in May 2009 the finance company wrote asking for a final(bullet) payment of £9400 but they would not take the car back instead. As there was negative equity in the car my only option was to re negotiate this sum over a further period of 3 years however they did not issue a new finance agreement but sent a letter confirming new payment amount with interest added.is this still an HP contract ie do they still have security over the car?

Hi Caseysunshine

Welcome to The Consumer Action Group.

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.

It can be bit confusing at first.

Please be advised that my time will be limited for the next few weeks. Thanks for your understanding.

Sunshine, you ask about laws in Scotland. I presume that the finance Co. has it's HQ in England. Check your agreement closely, and if they are English based it will probably say that disputes will be settled under English law. If you are still unsure, get someone to ask them. It's strange to ask for balance before end of contract period. Sorry can't be of more help.
