anything i can do about charges?

hi im having problems with reliable collections about a mail order catalogue. while i dont dispute i owe them money, i think the charges that they are piling onto my accout is a bit heavy. my balance now stands at nearly 400 when the goods i bought didnt even come to 150. i have made payments although not recently and i reckon ive probably given them about 100 altogether, although this was before reliable got involved. can i do anything about these charges? i am going to send reliable/jacamo a second telephone harrassment letter each today anything else i should include?

You can claim all the penalty charges back, but first you need to know exactly how many and what date the charges were applied to the account. Do you have all your statements from when the charges started being applied?

That would be your only other option yes.

Send it to the orignal creditor not the un-reliable ones

the only sar template i can find is the one for bank charges. can i use this one or is there another one out there for non banking related issues?

i know its made interesting reading on here i never knoew they had so many catalogues. my mum is having issues with them too so trying to get her sorted aswell. they seem to be charging me 12 per letter for now anyway. ive also had to send a few letters to them as they have phoned me something like 28 times in 5 weeks, including 4 calls in the space of a couple of hours.

i have, the first got ignored so isent a second recorded delivery and i havent heard from them for a day or two so hopefully they got the message. before i sent the second they actually had the cheek when i challenged them to say they keep calling because i wont speak to them and will carry on until i do. somebody on her was kind enough to draft me my second letter and it seems to of work, for how long though i dont know.

If you have responded in writing,then you have no obligation to deal by phone-and if they are told to stop,they should do it.

its mostly been jacamo calling with the ocassional call from reliable. the incident the other night with the 4 calls were 3 by jacamo the 3rd being the one where i was told theyd carry on calling as long as they needed, that was followed about ten minutes later by reliable. that was when i consulted you guys and had the complaint letter made up. ive sent the letter recorded to there head office in manchester. i got the address off companies house. like i said it has quietened down, i checked and it was delivered friday and they havent called so far. they have called every sunday morning the past month or so, so we will see if they do tomorrow.

You need to be making a log of these calls by date and time.

thanks martin3030 anything you have to help me get one up on theses guys i appreciate. it just annoys me when you think about how many people they must beat into submission and they end up making payments that they cant afford. stuff like that has the opposite effect on me and makes me more stubborn. and i have been keeping a log although only the past 5 or 6 weeks but there has been only 3 days in that time they havent at least sent me an automated call, up to the last couple of days anyway.

Yes JDWilliams is certainly no stranger to the Financial Ombudsman Service.

In the last half of 2010 61% of complaints dealt with by the FOS submitted by JDW complainants were upheld in the complainants favour.

Many new cases were also filed,with most of the complaints revolving around bank and credit issues.

The course of action as I see it should be

 

1.Deal with the collection/recovery attempts by reliable collections-this done in writing.

 

2.Prepare and send a full SAR to Jacamo-this needs to be quite specific in order to get you not only statements,but other things as well.

 

3.Put Jacamo on notice that these issues are going to be challenged.
