Is it your initial application for DLA or a renewal? My wifes application took almost a year with appeal but only a couple of weeks on renewal.

 

i got a call from a decision maker last thrusday completely out of the blue....i received my failed notification a month ago and then i did a review as they based their decision on the failed medical report i got from atos....how ridiculous....the DLA guy rang me and asked m about my meds i was on .... i had rang n my carer several times before my decision and updated the new medications adn doses i was given but it seems the incompitent call centre agenst didnt update my claim...so i gave the DM the med sto best of my knowledge as i was on my weay home from a hospital appointemnt...he then said he was going to refer my case to the onsite doctor for a review.....then i rang up on firday as i was panicking id missed something out n the lovely call centre advisor said to me im oplease to tell you we hav awarded you lower rate for both and you will get this until the ned of 2013 then will have to re apply.....im so kbloody chuffed with this as i really dont know if i have the fight for another tribunal hearing in me.....so im just glad now i can afford to get taxis to those consultants apps i have that i cant not attend instead of relying on friens to hold me up ad get me there and back on the bus......now im just in the middle of appealing my group from the WRAG group to the supprt group theyve told me when they recieve my lette with detailed info of all my meds, my illnesses my symptoms form my illnesses and the side effects from my meds and how they affect me daily form being able to leave my house and get out of bed my GP has sent a letter in it was short but blunta dn stratight tto the point and i sent a brief letter when i asked for appeal but this 2nd letter ive sent has all my meds detailed the dosages my sympotms n side efffects and all the contact details of all my specialist doctors and consultants for my different illnesses......fingers crossed im goin to get put in the support group each day is a nightanre as uit is n getting outr of bed is a massive struggle that reuqires help from mates n my other half so dunno how im goin to get to WRAG apps at my jobcentre?!!!!! keep your fingers crossed for me guys and wish me luck got a call from a DM in the appeals dept today who said as soon as they recieve my detailed letter hes going to deal with it personally and will let me know the decision within the next 2 weeks.....and hopefully hes a proper human who can read properly and will get the jist of how hard things are or e and how goin to jobcentre will have a negative effect on my declining health!

glad your wife got the DLA in the end i dont get why they make all this stuff shuch a fu***n battle it shud be easier and way less stressful process than it is!!!!!

they took the atos report which gave me 0 points in my first DLA decision but i asked for another DM to look at it and gave the advisor blunt and real things about how my illnesses affect me and then got a call 1 month later n was awarded lower rate for both...........cvall them and diont give up the fight i know its hard and it makes u feel like u goin crazy and getting more unwell but if u got a good case and are genuinely unwell and have proof from consultantas and gps you will get what you desere and is rightfuully yours....goood luck with your claim youll get there in the end in the meantime ay questions ont hesitate to ask me ( mind u if i dont respond straight away i hae fkluctuating days where mos days i cant get out of bed ) so the reoply may not be straight away but i had to go to court for ES AND THEN APPEAL THE dla SO IVE FELT THE ****TY END OF THE process ad know what is needed to get what is rightfully yours just get as much supporting evidnece from consultants and your specialist doctors and youll be fine!!!!! supporting evidnece is the key factor in this whole crappy process!!!!!!

Why on earth are you claiming DLA for controlled mental health issues? You can't.

 

I have no idea. I went from no DLA to LRM & MRC after sending in a copy of a letter which was sent from the psychiatrist to the GP explaining the diagnosis, a copy of my care plan and oh yes details of the meds I have been put on by the psychiatrist.

 

Considering everything else that is wrong with me and my ability to cope, the mental health aspect is a walk in the park. I honestly don't have any problems with it, it doesn't create any needs. They seem to have accepted that because of the evidence, I MUST have the needs but haven't told them what they are!!!!

The SOR clearly says that they have only considered mental health.

 

I'm not going to argue with them and I still I fight on for the needs relating to my other problems to be recognised.

WoW!!!! Just received the post this morning and I have had my LRM uplifted to HRM Indef!!!!

 

It just goes to show that by telling your GP what your problems are they repeat it to the DWP!!!

That makes no sense. Obviously, if the medication causes nasty side effects, then yeah I can understand it.

Don`t understand it either he can be ok for weeks/months but then he can go off his head hese schizophrenic sometimes they don`t take their medication no one can force them to do so. I always thought people could get DLA for depression? that will be on what grounds my daughter will be claiming DLA for as she as no physical problems. Thank heavens my 2 older children have never suffered with any form of mental illness it`s been awful for our family over the years. You could not contemplate so much misery in one family.

I am pleased to say that after a year and 3 months im finally in the support group......i got put in WRAg BUT AFTER WRITING WITH THE HELP OF MY CARER A 4 PAGE LETTER OUTLINING IN GREAT DEPTH MY ILLNESSES SYMPTOMS DAILY PROBLEMS AND THE DIBILITATING EFFECTS OF MEDS I HAVE TO TAKE TO KEEP ME ALIVE AND AFTER FIGHTING THE dwp HARD FOR AOVER A YEAR AND GETTING MORE ILL DUE TO THE STRESS AND UNCERTAINTY IVE WON . apologise for capslock but now just to let you all knowe there is hope

 

things to remember in an appeal

gety supporting documents from GPS Consultants at hospital and copies of prescriptions also sometimes its better to be frank i was embarrased telling a stranger some iof my problems which are very embarrasing but they need to know......the only problem is i was put in the support group january 2012 and apparently my ESA is up for review in april this year jeez i thought they would leave me alone for a few months at least to tryu and rwest and get better but obviously not hopefulyy whoever looks at my claim will read all the docs included and notes left from advsiors so they can realise theyve only just put me in the group and that means i cant work at the moment i cant wait to hpefully be back ion my feet and go and get some meaning to my life and get a job but until then im goin gt to hacve to keep fiughting the t***ers at the DWP to prove my case i get that theres so many scroungers in this counrtyu oim from a place were most people get hevery benefit and never have never will work have no aspirations etc and thats why i left there and know im unwell looks like im stuck in this rut surviving on the minut bit of money i get whichs not much i want to know how these spongers managed to fake there illness as ive hadf to priovide so mucvh evidence if your unwell where would you get that from?

anyways a bit of hope to everyone oin the appeals stage fight them its tiring and you will feel upset angry and drained but its worth the fight!

I am waiting for my tribunal date for DLA and have spoken to them asking why they are not taking the fact that the ATOS report done on me for ESA awarding 6 points (so failing me) was over turned by an ESA decision maker without any further medical evidence, into consideration, they have said that they are basically just ignoring it:( It strikes me they make up the rules and regulations as they go along.

 

they diod this to me with DLA appeal it i did and i won im just currently battling to get a higher rate as my healths getting worse but found out last week theyve had to write to a consultant for advise lets hope my consultant knows enough about my daily needs as i only get 15 mins app with her each month its ajoke but appeal it and then when u appeal the ESA and win it they will probably give you DLA they did that with me good luck anyways dont let them get u down!

They may have written to their medical services for more information.

 

they did this with me in december 2011 and by january 2012 they had decided i should be in the support group with my case reviewal due in 2 months which seems to contridict the poiint of being placed in the support group but suppose its the ESA merrygo round my welfare rights advised me of just keep with it get as much supporting evidence letters from GPS etc and also copies of prescriptions if you have a lot of meds

good luck with the appeal hope u win keep fighting the DWP......the sick and disabled shouldnt have to pay for the mistakes of governemnt and the thousands of fit people scrounging and false claiming benefits its unfair coz us genuine people dont get anywhere withoput a fight its unfair
