Can someone please help me..

i have just received a county court claim form today from Restons.

Basically as I was unable to pay my CC to mbna they have assigned to Restons to collect the £4500. I remember a while ago MBNA were willing to take a short settlement but I missed the chance as I didnt have the cash. Now Restons (the little xxxxx) were soo arrogant and rude with me on the phone..

I filled out my income and expenditure and sent it off to them with a proposal £50 a month, they replied back saying its too less and will be proceeding legally.

I then rang them and in panic mode I begged him not to take it legal and would be willing to pay £100 after borrowing money from my family. He was soo rude and reused.

I know there are alot of posts on this but I am soo confused as a single parent with a 7 month baby I just dont know what to do anymore.

Please can someone give me some guidance??

I havent received a default notice from MBNa I even called them and explained how rude Restons were but they terminated my call.

I would really appreciate any response as to what steps I need to take with the court action and what information i would need to request MBNA or restons to send me.

Thanks

Hi ASR,

Sorry to hear you have Restons on your back.

The best thing to do is start your own thread in the legal forum giving as much detail of the history, have you got a copy of your CCA?

I am sure lots will come along to assist you.

If you are stuck with starting a new thread, hit the triangle with an exclamation mark in it, to the left hand side of the post. This will alert someone in the site team and they will get the thread started in the right place for you.

  • 8 months later...

any update?

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
