Hi, I received a letter that the redetermination was dismissed as I could not attend due to being ill. Even though I sent in a letter before the hearing and all my evidence that I could not afford to pay this at once. I have received C Order letter on my name and my partners name. As the amount is less than £5k can I turn up on my doorstep and demand full payment? as I cannot afford this? What shall I do now as I have not heard from Restons? shall I call them and offer a payment proposal?

1) i dont think anyone has bought it as it was damaged somehow it was impounded as the finance people visited the address I gave of where i thought the car was. Not sure how the car got impounded 2)All the documents were with BMW as it was on finance I never received any documents to the car? My question is that if I contact the impound what will the procdeure be will i incurr charges?

Hi Divie, I filled all the forms in and dropped them to my local court I then received a judgement for claimant form the court stating the claimant does not accept my payment and that I should pay £4800 including £205 charges What can I do to appeal with income and expenditure as I cannot afford to pay this amount?

Hi there, A couple of years ago BMW finance appointed Wragge and Co to repossess my BMW that was on finance. Unfortunately I could not return the car to them as I had hired to somebody and he was involved in a accident. I could not get in touch with that person and hence did not know where the car was. However after bitting the bullet I decided to learn an expensive lesson and went to court and BMW got a charging order on my house. Upto this day I am paying £250 per month towards the debt of £37k A few days ago I went with a friend who had his car impounded due to improper parking and realised that my very same BMW is in that impound god knows how it got there. my question to all of you is that what are my chances of retrieving that car? does that car belong to me as BMW have a charging order on the full value? what is the best action I should take?

Basically I have received the following: A Copy of my executed agreement an upt date terms and conditions a copy of my most recent statement with £165 legal costs and charges I also requested a Default notice that was sent originally (which I didnt receive) but there is no mention of that. I really think I havent got a chance to fight this. I really want to get the best solution for myself. Please guys what would you do if you were in my position? I dont have long. I can either file my defence or if I wanted to admit the debt could I file an admission form and send it to Restons or is it too late?

Hi guys, I received my SAR request from MBNA today a copy of my agreement that I had signed in 2004 and also terms and conditions. I just dont know which route to take now. Im just wondering whether I have a leg to stand on?

Hi guys any input on the above? I filed my acknowledgement on the 5th sept when do I have till to file my defence I posted my SAR request to MBNA on the 26th August but to date no reply whatsoever

Also I will be filling a short defence on the basis of not receiving a DN and not receiving all the information/docs that i have requested and neither have they wrote to me YET acknowledging my request. From what I can remember I have never had a DN from them. If I acknowledge the court action within 14 days will I still be able back out and offer them a proposal by filling out a financial summary form? Im just thinking if they denied a £50 proposal there is nothing i can do to increase that it will either be that or even less.

Right guys, I have uploaded the file with all the correspondance and letters in order of when i received them. I have also sent the 2 letters to MBNA recorded delivery with £11 postal order Now I have a few questions: 1) when do I acknowledge the court letters? I know I have 14 days and it may give me a further 14 days to file my defence? does that mean if I do it on the 14th day it will give me more time instead of doing it today? 2) I see they have included a income and expense form, if going forward I wish to withdraw going to court can I still offer them a payment proposal or will it be too late then? Any help will be much appreciated

I just feel like all the doors have closed on me the only thing that keeps me going is my 7 month old starring at me with his puppy eyes. anyways I have received a court action by Restons on behalf of MBNA. The story in short is I have a cc with £4500 taken out on or around 2004 ive been struggling to make payments they offered me a short settlement for £2k last year but i did have money. After which I made some payments here and there of around £50-£100. They kept on calling me on my mobile but I just didnt know what to say to them. I then got a letter from them saying I have limited time for them to help me. Then I get a letter from Restons beginning of August giving me 2 weeks to fill in the income and expenditure form and propose a payment plan in which i stated £50 I was abit late in sending them the forms and they got it on the 18 august. I then get another letter saying £50 in not enough and that they will be processding with legal action. I started to panic and rang them and begged him not to take it to court and that I can borrow £100 and pay that a month, he was absolutely arrogant and refused saying we will take it to court. Now yesterday I received a court action and just dont know what to do. I know this thread is in the same subject but there are so many posts that I just dont know where to start. Can someone please help me as I am really confused. thanks

Can someone please help me.. i have just received a county court claim form today from Restons. Basically as I was unable to pay my CC to mbna they have assigned to Restons to collect the £4500. I remember a while ago MBNA were willing to take a short settlement but I missed the chance as I didnt have the cash. Now Restons (the little xxxxx) were soo arrogant and rude with me on the phone.. I filled out my income and expenditure and sent it off to them with a proposal £50 a month, they replied back saying its too less and will be proceeding legally. I then rang them and in panic mode I begged him not to take it legal and would be willing to pay £100 after borrowing money from my family. He was soo rude and reused. I know there are alot of posts on this but I am soo confused as a single parent with a 7 month baby I just dont know what to do anymore. Please can someone give me some guidance?? I havent received a default notice from MBNa I even called them and explained how rude Restons were but they terminated my call. I would really appreciate any response as to what steps I need to take with the court action and what information i would need to request MBNA or restons to send me. Thanks
