Even at my age there is quite clearly a PCN envelope by the windscreen wipers on your car on some of the photos.  But as I said in the IPC letter, that is not the dispute. The dispute is that CPM sent you the second PCN on the 28 th day of the issue date of the first PCN. It should not have been sent until the day AFTER the original PCN was issued. Therefore they broke the Act, they breached the IPC Code of Conduct and their agreement with the DVLA. It is something that the IPC cannot ignore since to do so will bring the ICO down on them and the DVLA should ban CPM from getting data from them once they know if the ICO do nothing. The minimum I expect is that your PCN will be cancelled. But it is up to you. I have given you the details, you have copies of both PCNs sent to you on the sar  with all  the relevant dates.

    • The Private Parking Code of Parking has been postponed as the poor dears are frightened that thew will all go out of business once it becomes Law. We all wish but nothing could be further from the truth so doubtless most of them will have to change their ways if they don't want to be removed as approved parking companies. Thank you for still retaining and producing the original PCN which, no surprise, fails to comply with the Protection of Freedoms Act 2012 Schedule 4. [It even states the vehicle "breeched" the terms  when it was the driver that allegedly breached the terms}. It fails to specify the Parking Period and whilst it does show the arrival and departure ANPR times on the photographs [that I cannot read] they do not include how long you actually parked nor was it specified on the Notice  [photos don't count]. So that means that you spent even less time parked though it would help had you not blocked out the dates and times, so good if you could please include them on your next  post. Pofa  asks the driver to pay the charge S( [2][b] which your PCN doesn't though they do ask the keeper to pay.and they have missed out theses words in parentheses S9[2][f] ii)  (ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid; All of those errors mean that the cannot transfer the charge from the driver to the keeper. Only the driver is now responsible . What a rubbish Claim Form -doesn't even give the date of the event which it should.  
    • it doesn't matter what you are being charged or if you missed the discount period. you ain't paying anyway..... if this ever gets before a judge. then the ins and out of POFA2012 or any IPC/BPA guidelines might come into play. until then i go get on with your life. you are spending far too much time on a speculative invoice scan scheme  its almost as if you believe these are fines and enforceable in a criminal court and you could have bailiffs at your door any minute.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I have just signed up as in desperate need of some advice regarding the DWP selling my apparent debt (which does not even exist) to a debt collection agency.

Sorry if this is going to be a long one!

I stopped working July 2010, for a short period until sept claimed Income support along with council tax benefit until sept 2010.

I notified DWP that there would be a change and I would no longer be entitled to IS from 26/09/2010.

They immediatley stopped my benefit in Aug 2010, until I could sent further evidence, which I did and recieved £56 In October.

In Nov Council tax wrote to me about my benefits being stopped in Aug so I owed 3 weeks in Sept, I managed to prove that I was still entitled to IS at the time and they cancelled the debt.

 

In March 2011 I recieved a letter stating that I had been overpaid an amount of £196.32 in IS 31/8/10 to 21/09/10 and they had sent the debt to a private debt collection agency.

I contacted the DWP who confirmed I have never been overpaid, and following this I phoned the DCA to discuss this, they did not have anything on file.

I immediatley wrote to the DWP to query the suscpicious nature of all this and asked them to confirm in writing what the situation was. I still have no reply.

 

Last week I recieved a demand for payment from the DCA so in turn phoned DWP again who again confirmed I had never been overpaid, I then spoke to the Debt management dept, who said they have sent a debt to a DCA, I asked them why and was told it was out of their hands and the DCA needed to deal with it. I spoke with DCA which was an experience I never want again! the man on the phone would not even listen to me trying to explain that a mistake must have occured to be called a liar and then he 'shouted' at me that if I did not pay immediatley he would be taking it further, and would be calling on me for payment in the evening!!!!

I have further spoken to IS benefit who have looked over my file and confirmed for a 5th time I have never been overpaid, but as they only deal with live claims they could not assist me further with the matter! I have since put a bundle of all correspondence together and sent to DWP, Debt management dept, and DCA to prove I was entitled to IS at the time, and included my query letter and a letter explaining the events of last week, and demanded someone takes responsibility, and that I get a response from all parties about what they are going to do about the matter.

 

I do not know where I stand on this as nobody will deal with this (other than the DCA and only in respect of paying them money).

Can DWP 'sell' my debt without even notifying me that they have a debt on file or looking into the matter?

Has anyone else ever experienced this, or have any advice for me on what I can do to sort this out as so far nobody appears to be able to assist with the matter!

I would send the 'prove it' letter to the DCA which should make them delve a bit deeper for information. It is for them to prove the debt and not you to prove you do not!

 

Keep everything in writing, and unless you can record calls, do not contact anyone by telephone.

 

Unfortunately it is a sign of the times with passing around your personal information.

It wouldn't be CCS collect by any chance?

 

They are/were (been quiet for a while) hassling me for a DWP debt belonging to someone else (same name, different everything else)

 

I would phone DWP debt management directly, tell them that you refuse to deal with the DCA under any circumstances as your details should never been passed to them, and ask for a copy of their complaints procedure.

The DWP are using a raft of DCA's for this sort of thing now and none of them has any background in dealing with this

sort of problem and have no knowledge of the enormous amount of law and regulations of the social security acts.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

Thanks again everyone, so far I have printed off the templeted (altered it first!) and posted it first class to DCA with proof of postage.

Also I have requested a SAR from the DWP, so hopefully that should be sent to me soon so I also have all details IS and debt management hold about this.

I have also wrote a complaint to the debt management department of DWP as by looking at the website they have not followed many of the standards they are supposed to work to also they suggest that they only use DCA only when their debt recovery has been exhausted, as they have never made contact with me I have sent off a 3 page long complaint.

 

Been at it all day now, really appreciate the advice everyone.

 

By the way the DCA is credit solutions ltd, csl, based in surrey. Have just also worked out they keep phoning me with an automated machine!!

 

Any further advice would really help if anyone knows of anything more I can do about the situation.

With regard to the SAR, you will probably get a letter back from the DWP asking you to specify which information you want.

 

The one I got had a list of benefits with tick-boxes, and a space to write in any other info I wanted.

 

3 letters back & forth, each time they asked me to be more specific as I just wrote that I wanted a copy of 'all the information the DWP holds about me'.

 

There is a thread on here somewhere with a link to someones blog which also talks about how DWP employees are instructed not to release certain info unless it is specifically asked for.

Also, it is free to SAR the DWP, so don't waste a tenner on that 'cos you'll probably need it for stamps!

You are doing all the right things.

 

You should also get your MP involved in the matter, ask him or her to make representations on your behalf. Live claim or not, when an MP gets involved, there is a process where every piece of your claim will be put under the microscope. They will respond to your MP who will then forward the response to yourself. Where they are unable to justify their actions, you will usually get an apology.

 

But sometimes, an apology just doesn't quite cut it. That's why, when you have a final response and an apology you should put in a claim for a consolitary payment for injustice resulting from maladministration.

My advice is based on my opinion, my experience and my education. I do not profess to be an expert in any given field. If requested, I will provide a link where possible to relevant legislation or guidance, so that advice provided can be confirmed and I do encourage others to follow those links for their own peace of mind. Sometimes my advice is not what people necesserily want to hear, but I will advise on facts as I know them - although it may not be what a person wants to hear it helps to know where you stand. Advice on the internet should never be a substitute for advice from your own legal professional with full knowledge of your individual case.
