      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All

 

I would apprecate a bit of advise please, I sent a PPI complaint to RBS a month ago , reference a personal loan that finished in 2009 I have just had an offer letter ( please see attached ) offering to refund the insurance premiums and interest that I have paid to 28th May 2004!!! I make that 7 years old and I beleive that they only have to go back 6 , I will send a SAR I think just to try and work out whats happened !! I think that in 2004 a loan that was nearly paid off was combined with the loan that finished in 2009 as I was told it would be better for me , have they got things mixed up or am I being THICK !! any suggestions welcome :-(

and been refunded all premiums and interest then you've had a correct refund.

 

The 6 year thing is usually on credit cards.

Thanks for that I am being thick :-) !!! sorry I did'nt make it clear in my post but thats just it Ive not had a refund of anything !!!! I dont know where they have got the £1,760.58 from but I never got it :-( I only found out that I had been paying PPI on the loan when I looked through the aperwork on an off chance a month ago and had been paying it right up untill the end of the loan in 2009 ,

Thanks for the info on the 6 year time limit I thought it was on all loans not just credit cards

Curly Bob,

 

You are not being thick. Banks and other credit companies set up things like PPI to be as complicated as possible, so the average Joe cannot understand it.

 

Unfortunately the text in your link is just too small to read.

 

Please try and repost with larger text.

 

If all the necessary information is there you may not need to send a SAR.

 

 

According to the FOS guidelines in order to put the customer back in the position they would have been had the PPI not been mis-sold:

 

1) The bank must refund all premiums paid under the agreement plus any associated interest. ie: Monthly repayments x no of repayments.

 

2) Pay the customer at 8% simple interest per annum on each monthly repayment from the date of repayment to the date of settlement.

 

You should have known this claiming that you used to work for the FOS.

Thanks for steping in and having a look I will try and attach a better copy , hoever theres not that much information on it just the usual template mainly , and was sent with a reply envelope ,a copy of the FOB booklet how to make a complaint ,and an acceptance form to sign in agreement that this is FF oh and yet again they are asking for Me to visit a branch for a signature ( they have been asking for this a lot recently with various matters :mad2:)

Thanks for reposting and as you suggested there is not enough information on the letter to do proper calculations.

 

Normally I would agree with you that the way forward is a SAR, but I fear RBS will just come back saying we do not hold any records as it is more than 6 years.

 

Do you have another way to obtain the information we need?

 

1) Amount of loan and/or total charge for ppi

2) Interest rate charged

3) Number of monthly repayments

 

I realise it is a long shot, but do you happen to have a copy of the loan agreement?

 

Or perhaps you could check on your bank account how much the monthly repayments were?

 

Also suspect you would have been charged PPI on the consolidated loan you took out in 2004 which they have made no mention of refunding.

Sorry no luck with the first loan agreement but I have found the agrement for the Consolidated loan , the bit im a bit confused by is the part in section : 2 £3466.74 cash loan to refinance existing RBS debt it take this to mean pay off the old loan ? £6533.26 for repayment to the Bank Account no ********** this account number is the one that i made the original complaint about and is the same number they quote on there letters , can you advise please .

I can help you with the calculations for the consolidated loan. Just need to know what date this was taken out.

 

With the first loan, do you know how much you borrowed and what the interest rate was?

Sorry I have no details available for the first loan I think it got lost with my house move ( very lapse I know) , with the second loan I beleive it was taken out on 2nd June 2004 the first payment was 21st June 2004 and the final payment was 21st June 2009.

hi have I worked this out correctly ?60 x £45.19 =£2,711.40 + 8% = £2,928.13 and is this the amount I should be asking to be repaid?

Bob,

 

I am a bit pressed for time at the moment but will take at look at the calculations for you asap.

 

Looks like you have a fair idea what you are doing there though, just make sure you calculating the 8% on each monthly repayment from the date of each payment until the date they repay you.

 

Now as it is impossible to know if or even when they will settle, I would use 30th April 2011 for the purpose of this calculation.

Hi all just a quick note to any one dealing with RBS PPI at the manchester address :

In the last month Royal Mails track and trace on three items sent to this address Recorded delivery has shown "still in our system awaiting delivery "

after ringing RM they have said that they apear to have got lost ???!!!:mad2:

a bit suspect me thinks !!

so may be a good idea to check if yours have been delivered !!!

Don't forget that RM will give compensation for lost letters (usually a book of 6 first class)

If you have sent your letter by Recorded /Special delivery and it is showing as not delivered (however they want to phrase it) then you should definitely claim at the very least the postage back as advised by Silverfox.

 

What is very annoying is that even for Special Delivery these companies sign for a bulk delivery and that isnt what you paid for.

Well guess what a second RD leter has got lost to this same address !!!!! very suspect me thinks RM after many phone calls are going to investigate and I mentioned citizenb's comments re not the service we pay for, so they will check the methods used for signing , will update when I know more

Just a quick update now a 3rd RD letter has gone missing to this address I am starting to smell a rat !! been back to Royal Mail who have said that they are investigating however I have now out of the blue received an email from the Chairman & CEO of royal mail saying that the delivery problems are unacceptable and he will be doing his own investigation in to it ??? wll update when i know more
