Sounds like they are waiting for a District Tribunal Judge to decide to grant an appeal to the Upper Tribunal.

If that happens then it will get looked at again by lawyers who specialise in such cases, if it's rejected by the DTJ then it has failed.

So I assume you got your statement of reasons, pointed out an error of law and asked for permission to appeal to the upper tribunal.

 

At this stage thay can do a number of things - including order a new tribunal, give permission for an appeal to commissioners or refuse permission (in which case you can just appeal anyway if you've got a strong case). It can take a while, sometimes quite a few months.

well mind and i got a leter after the triburnal to say that was disallowed and why did not attend the triburnal a solictor didwhich i never met and never produced any letters or photos then after mind got on the case they said i was so so badly repsentlley that it should try again can i send a claim for dla again while this goes on

Yes, you can claim DLA again in the interim, and in fact its a good idea if there's been any deterioration of condition. But any rate you're awarded at tribunal will only apply until the date of your new claim.
