    • So as I stated, I posted my letter off but over 2 weeks later I've had a visit from one of their reps. I didn't indulge him in any conversation, and I just stated that any such debts are statute-barred and closed the door on him. I was hoping they'd take notice of the letter. Where do I go from here? Thanks
    • I apologise if I was being unclear. Where it currently stands is that they will have it repair, placing scaffolding in our garden for 5 days. They have moved fast, but we will still have to postpone our contractors, meaning, we won't necessarily have the work done in time for the wedding and therefore will incur additional expenses for either a marquee or a wedding venue. They are vehemently against having any kind of liability in any regard but continue repeating that they are legally entitled to use our garden for their repairs (I believe this is true unless the work can be carried out using a cherry picker). The neighbour seems either indifferent or oblivious to the fact they can't reach all of the side of the roof from the space where they can place the scaffolding. They have asked their roofer of choice about using a cherry picker but the roofer has said it wasn't possible. It's not clear whether the roofer doesn't want to use a cherry picker or whether there is an issue with it. They have told us it is a problem that we are installing a gazebo as it will prevent them to access their roof from our garden in the future?!?  
    • Couldn't agree more, really wanted a true ruling on this just for the knowledge but pretty sure the Judge made some decisions today that he didn't need to?.. maybe they all go this way on the day? We hear back so few post court dates I'm not sure. Each Judge has some level of discretion. Their sol was another Junior not even working at their Firm, so couldn't speak directly for them! that was fortunate I think because if she would have rejected in court better, she might have  been able to force ruling, we are at that point!, everybody there!!, Judge basically said openly that he can see everything for Judgement!!!  but she just said "I can speak to the claimant and find out!" - creating the opportunity for me to accept. I really think the Judge did me a favor today by saying it without saying it. Knowing the rep for the sol couldn't really speak to the idea in the moment. Been to court twice in a fortnight, on both occasions heard 4 times with others and both of my claims, the clerk mention to one or both parties "Letting the Judge know if you want to have a quick chat with each other"! So, it appears there's an expectation of the court that there is one last attempt at settling before going through the door. So, not a Sol tactic, just Court process!. Judge was not happy we hadn't tried to settle outside! We couldn't because she went to the loo and the Judge called us in 10 minutes early! - another reason to stand down to allow that conv to happen. Stars aligned there for me I think. But yeh, if the sol themselves, or someone who can make decisions on the case were in court, I would have received a Judgement against today I think. She was an 'advocate'.. if I recall her intro to me correctly.. So verbal arguments can throw spanners in Court because Plinks dogs outsource their work and send a Junior advocate.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

 

I'm new here, so hopefully I'm posting this in the most relevant section - if not I would be grateful if it could be moved to the best place.

 

Very briefly - I have been the victim of identity fraud with several companies, all of which were easy to resolve except Carphone Warehouse. Two fraudulent mobile accounts were opened online in my name but at an unknown address, one of which resulted in a CCJ against my name. Carphone Warehouse have been totally inadequate in their dealing of this, and only 9 months down the line after a great deal of my time, endless calls and emails and some expensive calls to courts, DCA's, Equifax etc have I finally today got the CCJ removed.

 

I have not been able to get credit since July 2009 when I first discovered something was wrong, which has had an adverse effect both personally and for my business (not being able to re-mortgage, get a loan for house repairs or move house for example). Coupled with the shear incompetence of Carphone Warehouse this has caused an unbelievable amount of stress (definitely not needed as I am 6 mths pregnant).

 

I want to approach CW for a substantial amount of compensation, but want to make sure that I go about it in the best way to maximise the possible payout. I have had a good search of the forums but can't find anything that is quite relevant to my situation.

 

If anyone can point me in the right direction I would be really grateful, and if you need any more info just let me know - above is a very shortened version of events!

Hi I major problehad ms with Carphone Warehouse, this is what i did to get a successful resolution

 

Final update and a big thank you to buzby for all his help.

I eventually used the email on this site for Mr Dunstone :). Received a fairly prompt call from the CEO's office Special Cases Resolution team. Gave their apologies and offered £50 compensation, £25 to cover phone callslink3.gif. Apparently they will ensure that all the people whose names were listed will have furtther training:eek:

Many thanks for your replies. I was thinking I would like to try and get at least £2000 out of them - my life really has been on hold for a year and a half by not being able to get credit.

 

I have no idea if this is reasonable/achievable though or if maybe even it's too little! That's where I was hoping to get some advice, along with the best way to present my case to them!

You can try, there response would be

 

1. You were responsible for not protecting personal information.

2. Just because they did not take your word for it, doesnt mean they caused prejudice.

 

It is difficult unless they caused prejudice

With regards to my personal information - I understand that the responsibility would ultimately fall at my feet no matter how careful I was. I understand that fraud happens sometimes. It's an unfortunate fact of life. (I would note that the person I initially spoke to at e2save/CW did admit that they had no proper fraud checks in place for internet orders at the time this happened). I also accept that the CCJ was obtained. That again would be a natural course of progression with a defaulted account. My issue is with the way Carphone Warehouse has handled the case, and the fact that it has taken so long for them to not only get the accounts marked as fraud, but to then get the CCJ removed - in fact their so called Credit File Team, who no-one at CW has a phone number for, don't seem to even know the procedure!

 

Right from when I first contacted them I could prove the accounts were fraudulent and nothing to do with me. The matter should have been sorted within a couple of months at the maximum. This I could have dealt with - the things I needed credit for could have waited for that period of time without being too detrimental financially. A year and a half however is a completely different story and way beyond a joke.

 

Am I reading between the lines correctly with your reply that basically because the CCJ stems from fraud, CW can do what they like and drag their feet for as long as they like without recourse?

Thanks for your reply... I will definitely do that - I was just hoping to get some help with some points on how to maximise the compensation!

 

I have already been dealing with the Fanatical Support Team (basically a team dealing with escalated complaints) since November/December time, and they have already said they could offer me £50 once things have been resolved, but if I wanted any more than that I would have to go higher up.

Hi

No they cant do what they like but then again they cant do what anyone else likes also. CCJ's take months to remove and involves court intervention to remove them and a fee. I would be glad to have it removed but I dont think getting credit will become easier if they give ou a CIFAS entry which is in thier right to do so.

Im not trying to be negative in this situation but just try to get real point accross. If you think and have evidence that they did not deal with your account in a propper manner then you are entitled to a pay out which comes under prejudice. If its just a thought or anger then it could lead you into covering their costs if you do infact lose.

I already have CIFAS on my credit file - the first catalogue I discovered fraud with signed me up for it as I had no idea what else might be in the pipeline.

 

The actual process of getting the CCJ removed from start to finish (once I TOLD CW how to do it) took three weeks max - Bryan Carter sending a Notice of Discontinuance, the court issuing the Order to set aside, the update of the Register of Judgements and me sending a copy of the order to Equifax. There is therefore no excuse for CW to drag their feet for 18 plus months!

I wouldn't want to do anything in haste - I read about a guy during my researching on google who tried to take his bank to court and ended up having to pay £3000 in costs! I am 6 mths pregnant and don't need any more stress than they've already put me through, so don't want to go down the court route really anyway.

 

I have an e-mail trail for a lot of the correspondence, and everything else I have noted names, extension numbers, dates, what they promised to do etc. I also obviously have all letters I have received. I guess it's going to be a case of writing it all down, putting a compensation figure in, justifying it, waiting to see what they come up with and then using my best bartering skills!

Good luck with all of it, again I dont like to post negative comments but just like to ensure the OP knows what can happen if contested. If they have offered you compensation then they admit liability, If you could justify what you want and show you are wiilling to go further then you wont have a problem.
