Old HSBC Debt

Hello I was wondering if anyone may be able to offer some advice on an old debt I have with HSBC. I’ve been trawling through various posts on here & across the great WWW, but I’m finding it hard to relate this to my circumstances.

I had a personal loan with HSBC which has a recorded default date (from my credit report) of Dec 2006 although it says "file update to the period of Dec 2009" (not sure what this means?). This is registered to Aktiv Kapital (UK) Ltd for approx £5400. But recently this has been chased by Buchanan Clark Wells via letters & phone calls. This debt should be recorded against an old address. However I am now getting letters to my current address, which is 3 years on & 1 address removed from then.

I have made no contact with any company on this debt.

The questions I have are:

Can this be claimed Statue Barred?

What are the chances or either of the above companies being able to prove this debt?

By challenging these companies will I risk being able to claim “Statue Barred” in the future?

Can I get this removed from my file?

Or should I just keep my head down & wait until Dec 2012?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Financial in/out? How long would it take HSBC to register a default from my last correspondance?

 

The debt is from a unsecured personal loan.

From what I have gathered, if you miss a payment, HSBC's terms and conditions state that they can only report to the credit ref agencies as being late in payment after 28days has elapsed from the due date.

 

After that, it's passed to the collections dept who start the formal process to get a payment from you and will continue to report you to the CRAs.

 

It's only after 150 days from your account-file first being passed to collections that they can then issue a formal default notice which then appears on your credit file and stays for 6yrs
