    • Hi folks, I've just found previous documentation. I thought it had gone missing. I'd forgotten that I did appeal it through POPLA but I can't find the thread on here that, I assume, I posted for help. Appeal letter is dated 27/10/2020 with a rejection. I genuinely had forgotten about this so apologies for misleading you. A lot has happened in the years since the ticket was issued. We closed down a couple of businesses and moved to the opposite end of the country to retire. The documents I have are scanned copies. I no longer have the originals. If there's anything you'd like to see, please let me know and I'll post them, although it probably won't be until tomorrow now, but I'll be looking in on this page tonight. "Thank you for your email.   Thanks you for confirming that the vehicle does not have these features as stated in the advertisement.    I am sure you are aware that the Consumer Rights Act 2015 provides the short term right to reject within 30 days. Statutory rights cannot be taken away from a consumer, and any attempt to do so is illegal.   Please can you advise how best to return the vehicle?" Thanks in advance!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi,

im new to this site...

i know ive been stupid, but i currently have five outstanding payday loans

 

payday express

wonga

24/7 money box

1 month loan

quick quid

 

altogether the debt including interest is about 2500,

ive been paying the monthly interest off , which has been leaving me very short and so forced me to get another, which is whow i got in this mess.

 

i have a full time job, but dont earn enough to pay all of these off, to be honest, i wouldnt even be able to pay 1 a month off in full.

 

im getting scared that they will start contacting me on my work number, i work in an office , i share my number with 8 people, so this could prove very embarassing.

 

i have been looking for loans to pay them all off so i can get on with trying to have a debt free life,

but with my bad credit , loans are impossible to find.

 

does anybody have experience with this kind of problem,

or know of any loan companies willing to deal with people with bad credit.

 

as i said earlier i know ive been stupid, and have know1 to blame but myself,

but this is starting to get me down now, and i really just want to get it sorted!!!

it would be a real wieght lifted!!!!

 

any advice will be much appreciated,

DO NOT GO DOWN THAT ROAD - YOU WILL BE EVEN WORSE OFF

 

Payday loan companies are becoming more popular but really do not provide a safety net at all.

 

What you do need to do is get another bank account and have any income paid into that to prevent them taking alll the money from you.

 

Keep everything in email and do not speak to them on the phone without taking extensive notes and emailing the notes to the company as confirmation.

 

These companies like you to default before they can do anything but do not like having to justify their charges in front of a court.

 

Just because they may issue a CCJ it does not mean it will be awarded to them, there are defences around for this type of company which keep it short and sweet and just list fact, there is little legislation to use against them so using the facts is often enough to make the courts realise their claims are ill-founded.

can you log into your accounts with these lenders online and change details? If so, do it now.

 

Make sure you cancel any cards that they have details of. Better still, open a new account and have all your wages etc paid into there.

 

Email all companies involved and state financial difficulties. Make them all a reasonable offer of repayment but don't leave yourself short otherwise you will be back to square one.

 

You will probably have to put up with a couple of weeks worth of millions of phonecalls but stick to your guns, they will either accept your offer or pass to a dca. The dca will then accept your offer.

Don't worry. You're not the first to be in this position and you won't be the last. The advice about opening a parachute account is excellent. Try and get that done as soon as possible and have your wages paid into that. Co-op are definitely good. I've been with them for years. No overdraft facility which is good, but you can do DD's, SO's and are given a Visa Electron Card.

 

Your main concern is NOT these loans. You need to make sure you pay your priority debts, rent/mortgage, gas, electric, council tax etc.... these are important! Are you managing to pay these all right at the moment.

 

You would find it helpful to fill in an income / expenditure sheet for what you have coming in and what HAS to go out (not these debts - food, clothes etc...) so that you have a realistic picture of what is coming in and going out. You'll know then what, if anything, you have remaining to put towards these other debts.

 

Once you're in that position, post back and let us know where you stand and we'll plan the best way forward for you.

 

Phone calls can be stopped if they do start to phone you at work. It amounts to harrassment and there's plenty we can do about that.
