hi all

 

First time poster needing some advice on the following issue.

 

 

First of all, I have taken several payday loans out recently and now i realise something needs to be done.

I have started working on my own DMP and are now trying to get out of the cycle of debt.

 

one of my payday loans is about 200 and this was due to be paid last week but i could not afford this or even to roll it over and so decided to default and work out some sort of repayment plan.

I contacted the company involed and asked for a repayment plan. There first response was a email with a figure to pay back over a certian time frame. This surprised me as i thought that the comapny involved would not accept repayment plans so early after defaulting. The email sent to me stated that they would accept this if i logged in to there website and updated my card details.

 

I know this is proberbly a trick to get my card details then strip my bank account clean.

 

My question is this

 

If i respond by stating that i will pay by standind order instead and not pass on my card details and they refuse this. Can i just start paying the monthly amount by standing order and when finished state the repayment plan they sent me has been completed.

 

I dont think they will accept but i am trying to find out if i can legally hold them to the fact the email has stated a certian amount to be paid per month for a certian period that i accept and can afford.

 

Any help appreaciated

All the companies react differently, but most will do the same thing if you give them your card details. Just make it clear you will only pay over bank counter or by standing order. They will have to accept eventually on your terms (within reason). I would imagine a court would laugh at them if they realised you wanted to pay but by a different method to their preferred one. If you have the bank details by all means make the payments as agreed.

Remember to keep everything that is sent from them, if they state they are happy with your proposals what sane company would then not allow you to make the payments. You can tell them you only have a cashcard not a debit card so can only pay by order.

Well done for trying to get back on track and try to steer clear of these lenders.
