      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am writing to Minicredit again after a letter saying somone will visit my house between 6th-13th November, no-one yet and they cant actually do anything apart from bully me. I am writing the letter advised but adding a few extra notes advising them to take my offer, even though it's low its the only way I can pay them. Every little helps anyway.

cancel your bank card today report it lost, as these people will take out any money you have in. Dont let there texts letters or emails intimidate you, the FOS and OFT are inestigating them for breaching the comsumer credit act. Only pay back what you owe plus one months interest.

 

hiya im in the same position with minicredit and wonder if you can give me some basic advice i took 150 pound loan that was due on 1st november i missed this and since then hey keep entering my bank account and taking whatever gets paid in this is my money to live on and fo my kids xmas,i have repaid 500pounds already and they still say i owe 150 i emailed askin them to stop adding charges and saying the amount they have retook is disgusting but they are now telling me about doorstep collectors etc and will keep adding charges i just dont no what to do next i cant afford to let them keep taking money out my account any advice from anyone would be well and truly appreciated thanks guys:)

I have a surprising story.

I took out a minicredit loan for £100 last night at 11pm. it was approoved by 11:20 but no money came... So i started researching this company and came across this thead and said to myself HOLLY *****. I imediatly sent 4 emails requesting i cancel, i sent a fax to the number and i edited the address feild on my debit card to read. canceled do not pay loan! and went to bed a very worried man. In the morning i woke up to find many emails saying sorry the loan has allready been paid and true enough there was £80.50 in my account, S***!! So i thought right! and i drafted a 1500 word email using everything i had learned on this site and i was about to send when i recieved a call from Minicredit saying with out prompt they accepted the canceled contract and would take £80.50 as full settlement but i was perminatly banned from ever applying for a loan with them again!

So maybe they are learning, hopefully anyone reading this who has just got a loan and is fretting about it will follow what i did and can get out of it and apply to a nice company like wonga or someone. Im thinking it was the fax that did it and i just sent it from a free online fax site.

Anyway a small succsess

No amount of money can buy your sanity after dealing with some of these PDL companies !

There is a petition going round at the minute for Mini Credit (great idea) might be worth adding a signature !

hi i also recieved a letter from mini credit saying there are sending debt collectors to me i started with a 150 loan they now want around 780 i have sent them this following email

We have no alternative but to escalate the matter. Our doorstep collection agent will visit you from 1st January 2012 to 8th January 2012. Please secure payment.

To enable you to send a bailiff to my home you should in the first instance take me to court, win, get an order, I then have to break the order and then you can send a bailiff. I will not be bullied into making a payment to yourselves. I feel your charges are unjust, and am offering a repayment plan of £30 per month without interest or charges being added until account is cleared OR a full and final settlement of £200 - £50 more than I borrowed. I believe your letter is breaking OFT guidelines by the threat of sending someone to my home and demand payment, so a copy of this email will be sent to them. I am also formally requesting a full breakdown of the charges including full dates that interest was applied and at what interest rate on each date.

I await your urgent response today.

 

I have also contacted my solicitor and told him about the situation and he advised me that if this does go to court you have to justify all charges you have added on also any court will see the charges as simply disgusting and they will be wiped

 

was this the right thing to do?

Hi......I'm having a nightmare with this company!!! My £150 loan now stands at a massive £1000 plus.......I want them to take me to court now so that I can make an offer of a fair payment......I keep getting the threatening letters and phone calls but to date no visits or action taken. Ive made an offer of full and final settlement of £200 but they haven't responded......I refuse to be bullied into paying horrific charges by loansharks.....Although Payday loan companies do get a bad press, I set up a payment plan with Text Loans and this is being paid off at a rate of £40 per month!!! Surely, these charges are completely unlawful.....I'm not refusing to pay the loan off but while they are whacking on these astronomical charges it seems pointless even make token payments or would this look better in court if I did this......I just feel that if I make token payments this will just go on and on and on and I want an end to it! I know I defaulted, I made a stupid mistake by taking out a payday loan with these people but want to sort this asap. Many thanks in advance for any advice.

Hi I have a loan with these people they are awful no customer service at all my rollover payment was due of which you get four dates and I couldn't afford it until end of month so asked if i could pay it then I got told that if I left it til end of month the £200 loan I got would be £465 (fortunately I paid the £77) no way was it going to go to that amount.

But I would say to those who are worrying if you get behind and can't pay the worst that can happen with any of these sort of people is that they pass your debt on after letting to increase to an amount they are only allowed to go they will then pass it on to another debt collector who will send threatening letters then they will get fed up and so on but these people cannot turn up on your doorstep they are not allowed they will not take you to court because courts do not like these people and if worse came to worse and they did you would only end up having to pay £10 a week there is nothing these loan people can do bailiffs will only turn up on your door if you don't pay council tax or fines and after six years there is nothing they can do as the debt is written off of your credit file. So basically if you can put up with letters coming then just ignore them or put yourself in the hands of the CCCS who will deal with them on a debt management plan there is nothing they can do then this is what I have done - Good luck everyone

Yes it was there is nothing they can do they are not allowed to send doorstep agents its against the law they just threaten this to make people scared ring them and tell them to take you to court they wont and even if they do it will stop any charges and also the most they will get from you is £10 a week courts do not like these sort of people - keep a recored of every conversation you have with them and copies of any correspondence between you so if you go to court you can produce it but you wont cos they will not want to go to court.

Sorry Elainejo but they do take people to court, Minicredit in particular are nasty in that way.

 

What makes you think they can only get £10 a week from you? If you are on benefits you can pay £1 a Month, and the courts will take other debts into consideration.

Can I just reply to the last part of the above message please do not go to Wonga they are just as bad if not worse if you fail to pay them they will add charges until your account is well up to £1,000 only then will they pass you onto their collection agents they have passed me onto two and both of the collections agents are sick of wonga and passed me back to them fortunately I am on a debt management plan with the CCCS and they have to accept what they are being paid by them so please do not go to Wonga

just be so much easier if they would freeze interest and allow a payment plan but they won't. they told me every payment delays the debt collectors for 30 days. did you have people at your door. i'm a young mum of 2 and hate all of this. i worry every time i hear a car wondering if its debt collectors. such a weight to deal with. wish i never got involved

 

They cannot send debt collectors to your house without a court order. If they threaten you with this then they are misrepresenting their powers, keep a record of this should it go to court as the courts are unlikely to look kindly on this behavior.

 

Without a court order anyone they send round has as much right to enter your house as I do. Simply send them away adn tell them if they don't leave you'll call the police and have them arrested for trespass.

Bit late but I hope you canceled your card and didn't give them another penny. It's disgusting that they can do this to people.

 

Also, as they took the money without permission it's possible you could get the money back as what they've done is wrong. They can't send doorstep collectors without taking you to court first as it is an unsecured loan. They are unlikely to take you to court for the rest of the mony you owe as they would not want the judge knowing they've already taken money without authorisation £500 and they have consistently misrepresented their powers.

This was your post: 'They cannot send debt collectors to your house without a court order' - this isn't correct. They can send a doorstep collector, who would have no bailiff's powers. Also, continuous payment authorities are nasty, nasty things. Luckily there are steps being introduced to change how they work - the sooner the better.

Debt Collectors are NOT permitted to "just turn up" on the doorstep without an appointment - Please read the OFT guidelines.

 

If they do, then you can simply ask them to go away.
