I have to do some proofreading of an English grammar book for an Italian publisher this weekend - for money! - so I'm afraid corrections and suggestions will come in dribs & drabs.  I've totally knackered the layout, the numbering and the order of your Exhibits but there will be several versions done so don't worry about that ATM. Your arguments are superb. What is less superb is the way you jump from one to the other and back again, so I haven't changed your words, but I have moved the paragraphs around and given each section a heading. New bits are shown in red. Crossed out crossed out in black is something you've quoted from the government Code of Practice, but that has since been withdrawn so unfortunately that argument has to go. Your paras 7 & 8 don't harm your case but to me are waffle and can go.  Keeping the arguments clear & concise will always impress a judge. IMPORTANT - did you ever send Simple Simon a CPR request? Scammed by Richard Hall (Capital allowances consultants ltd - Clavering House) investments into Cryoblast Limited 15/16 (Paul Huggins - Clavering House) and Eco Cooling solutions 16/17 (Anthony Fitches - Clavering House).    Mccuminsky - scammed by Capital Allowances after providing his details to Stefan Brown Alpha Tax Consultants (Clavering House) payment made to Eco Cooling Solutions.    Robson - scammed by Capital Allowances - 15/16 paid to Cryoblast 16/17 paid to Eco Cooling.    Myself - scammed by Allan Maxwell - MaxTax (other business Maxwell electronics) registered to Clavering House.   Cryoblast Solutions and Fast Tax - Alan O’Hara    Please note there are two Cryoblasts involved - Cryoblast limited (Paul Huggins and Clavering House) and Cryoblast Solutions Limited (Alan O’Hara also director of Fast Tax).    My return simply said “Cryoblast” another thing that should have been clarified as part of HMRC guidelines before paying out the claim.    Cryoblast limited was already suspected to be involved in fraudulent claims before my investment as Huntly had open assessments issued in November 2018.    Cryoblast Solutions, the same company director as Fast Tax where my money was sent was dissolved before my claims were submitted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Due to severe health issues I don't do any paid work, but I do help people via various charities including this one.

Don't worry, knew what you meant. I require no payment for anything myself but, sometimes, I end up paying for it.

The best thing to do with internet stalkers is IGNORE them, let them rant on and on because no one listens block em every where you can dont read what they write very simple, and easy to do, they will go crawl back under their stone then, its feeding them they like its attention seeking, these people are very sad and have a mental problem, best to ignore them cut them off

i agree lady in red, ignore them, i have a stalker a real nut job though imagines all sorts of things going on, follows me all round the web, not that it bothers me really after all what can they do to you through a computer??? Nothing, if you dont want to listen to them then block them as lady in red has said, facebook emails every way you can even change your internet provider so your ip changes also, dont ever give in the these nutters, obviously they dont have a life but sit infront of a computer day and night, let them rant on and on, its drives them mad if you dont answer them and block them the police told us that to ignore them change you phone numbers emails, facebook, they havent got the guts to visit you and can only hide behind the computer, just laugh at what they write i do, they cant hurt you they believe they can but they cant, what ever they say or do you can prove its lies, and when they see you have logged it with the police as we have, when they do take you to court hey presto you can show the court all the emails and texts you have saved as we have, dont let them win, dont cow down to them they are bored little nobodys with nothing in their lives,

I've had a few stalkers and one was a right weirdo. One minute, she was lovely, then next she was a right cow. I remember her saying that she believed I was lying about my disabilities because I hadn't mentioned them straight away. Is there some unwritten rule that states I must do this? First I've heard of it.

 

There was another few people who stalked me too. Looking back, I think they're both sad.

 

On the subject of stalkers, a friend posted a picture of his-then workplace on Facebook. He wrote "and for you stalkers out there, this is where I work". I was the only one who replied! In my defence, I used to go past there to watch the football. (not to stalk him, I promise!)

i think they are all weirdo nyastagmite, you just have to ignore them im afraid, what can they do to you anyway, they may go and tell lies on you but if you have nothing to hide you havent got a problem, let them go shooting their mouth off to who ever wants to listen to them dont give them air time, they will lie about you either way just be ready to stand your corner and deal with it as we do, but you do get fed up with them forever stalking you though what do they get out of it i wonder? it doesn't hurt me at all, the police say ignore them and thats what i do
