Try and cut it as short as possible. My dad has an endowlment mortgage went to pay mortgage off three years ago in March 2007, to be told that he had taken two loans out totalling £10k and it had been added to the mortgage. £5k added to mortgage in Aug 1986, 6 months after in took mortgage out and then again in Dec 1987 another £5k. Dad shocked by what he had been told as he hadn't done this asked to see evidenced i.e signed evidence of two loan contracts with both my parents signatures on, as this is a joint mortgage or show him where the money was paid into i.e the current account also with Barclays. We have received a response from the financial ombudsman today saying that Barclays have said they do not keep data that far back and that they are not obliged to prove that he borrowed the money and also that they have decided that the Financial Omdusman service are not allow to continue to deal with this case. It's taken them all this time to come up with some lame excuse and we are expected just to give them the money. Don't know what route to go down next, If anyone can help would be greatly appreciated.

Barclays will of course say this-they have archive going back many years-but when it suits to reveal-in this case its not in their interest.

The FSA handbook says that limitation should begin up to 3 years AFTER it was discovered there was cause of action.

You need to get statements from as far back as you can and see if you can reconcile things.

If need be-and if you are prepared to do it-you could file for a Court order where Barclays would have to undertake a search and make a sworn statement to the Court that the info you request is not available.

If Barclays say they are not obliged t prove your dad has borrowed this money which has been added to the mortgage, then how can they be asking for it at all ?

 

You can't ask for money without showing (and proving) that it is owed. Therefore Barclays have to show evidence of how and why it was added to the mortgage with relevant paperwork.

 

If they cannot do this, then you can go to court and say Barclays are just arbitrarily say money is owed but they cannot say why or how.

 

I am sure any court would just tell them to get lost under those circumstances.
