Hopefully it should be enough to ward off any further issues with account closure etc  What you need to do is keep this letter and use it should any further account be closed from this further point. You can actually challenge it and provide the evidence - Should give the provider course to reconsider. May even beable to take it to your old bank etc     Also ask for confirmation from MCB that they will not be placing another CIFAS marker going forward to cover all bases.    Also one more thing,  - Please consider a donation when you get a chance Glad we could have been some help  
    • There has been a development Submitted the N225 application yesterday.   MCOL now states: A Bar has been put in place?? (Take it that means cannot enforce judgement) A defence has been filed with the court This has all happened on the 34 day, so a day late the defendant's submission.??? Options???   Please note that the defendant can still reply to your claim until the court has processed your request. If the defendant’s reply is late but arrives before or even on the same day as your request, it will have priority.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If anybody is facing court action for non-payment of maintainence fees by

either of these then there may be away out. Please read this link.

I have spoken to the barristers clerk and got some details from her.

Check your membership certificates, if it states the registered office as

being in the Isle of Man UK courts have no jurisdiction. She also told me

that the Isle of Man courts refused to issue proceedings as the company

registered there as a matter of convienence to escape UK Tax.

It is obvious that the companies are hoping no one knows about this as I am

waiting to hear my court date with them. I am defending myself and intend

to use this as my defense and ask the court to bring criminal charges of

attempted fruad as they know UK courts cannot hear these cases.

If you already have a court date you need to bring this to the attention of

your solicitor.

My wife and I now find ourselves in a situation where we are going to have to fight CBC International the agents acting on Pueblo Evita's behalf and I came across your post while looking for possible defences as we are also defending ourselves.

 

If you have had any success with this I would very much appreciate any advice, references, letter templates (anything useful) that I and others reading this could use to help them fight and win.

Just keep refusing to pay. They didn't take me to court last year. E-mailed them a month ago and told them to get on with it. Stated they would take e to court when they were ready.

Got new letter frm CBC last week Phoned them and said I didn't pay last year, they haven't takenme to court like you said they would. Am not going to paythis year so you might as well send it back to them.

 

Will let you know if anythig happens.

They try and scare their customers into paying, they have no compassion at all, however you do not have to pay...the defense is as above.... also they have now lost at least three cases...

 

For everyone's Info - Pueblo Evita has lost its RCI 5 * gold crown status..... Its now classified as a sliver crown resort for 2012

Hi I am new to this forum but feel relieved to have found a site involving Fairways. I am trying to get rid of my timeshare at Fairways and have now been issued with a letter from CBC threatening to take me to court. I first heard from them last year and they have reared their ugly heads again this year. My husband died and I didn't want to use the timeshare any more but all they keep banging on about is get the maintenance up to date. My husband was only 52 when he died after a long illness and I was the only wage earner so money was a real struggle. I even sent copies of Drs letters etc and a letter to the AGM and also numerous e-mails to Pueblo Evita. A few years ago we went from weeks to points then Pueblo Evita said they couldn't do anything as we were in points; so I got out of points and went back to weeks. Then they said they couldn't do anything as we owed maintenance! I said could I sell our holiday time to my daughters friends so they could go on a group holiday to raise the money for the maintenance but they said as the payment wasn't up to date they would not allow me to do this. I now find out that because I went from points back to weeks I have lost two years holiday entitlement which they still want me to pay for. Give me strength!!!! Any ideas? Shall I just ignore them? I have also been in touch with TATOC who are at the moment contacting Pueblo Evita on my behalf and although they are on my side but I am not holding my breath. I would be grateful for any advice.

Could someone please give an overview as to the situation.

Thanks sliverCrown.

I will look out the minutes for last year if I can find them. Also will be contacting a solicitor who specialises in this field for an initial consult on the phone and speaking to someone who has been through all this. I will let you know what I come up with if anything. My deadline for payment is 1 August. Do they contact you straight away do you know?
