I really need some help with this, I got a tv from brighthouse 2 years ago have never ever missed a payment last year my son accidentally cracked the screen i phoned them up and was told there was nothing the could do i would still have to pay as usual which i accepted they said i could hire another tv but i just left it as i could not afford it, Luckily my mum and dad gave me there old tv as they got a new one, I still continued paying every week the same amount they were still charging me the both insurances even though the tv was broke, Then i recently became very ill and have spent many times in hospital i am now on disability benefit i can no longer leave the house and i am finding things very difficult finacially, I contacted brighthouse and asked them if i could pay reduced payments as i was unable to pay £20 a week the said no thats not acceptable so i asked if i could cancel the optional insurance and the lady huffed down the phone and said i don't think you can as it was explained to you when took out the agreement so i left it at that, I couldn't go on paying so i am now in arrears i have had up to 20 phone calls a day, And the last week a man with a big van has been at my door 5 times and thats what is really frightening me as he bangs my door so loud and scares my little boy i live here alone with him and i'm so scared to answr the door, I am the only person who lives i this staire now as next door has moved out and the man has burst the staire door which my landlord just fixed by barging his way in cause no one would answer the buzzer!! He stands in the staire for about 10 mins then sits in van staring in the window i don't know what to do now can someone please please help me, I know he will come back and i really can't afford what i'm due them i'm very upset, Thankyou:(

contact Head office immediately, for you to be called so many times a day and someone sitting outside your house, this is harrasment and there are laws against this, I would suggest that you contact the head office ( number is on there website) and tell them everything, and I think ( I may be wrong) that if you have the BH insurenace accidental damage is covered, but check with head office when you call. The optional insurance is just that, optional, though as that is where they make most money, they will do everything to stop you cancelling it. Insist to them that you don't want it and that the agreement is rewritten without the insurance.

At the same time ask for the name of the are manager and his number, arrange for him to see the broken tv and ask him if he would pay what you're paying for a broken item.

For starters, contact BH via letter (send it recorded delivery which is 74p I believe) and inform them that the insistent phone calls and visits are harassment and you will be viewing them as such. If they continue you will be going to the police.

 

If you have paid more than half of your contract (which it sounds like you have), they MUST take that TV back if you ask them to. You won't be reimbursed for payments made, but you won't have to pay anymore either. OSC, which you said you had, however, should cover the cost of a repair, and if it cannot be repaired it should be replaced. Even if you did not have the OSC this would still be true as per the Consumer Credit Act 1974.

 

DLC which you are also paying should cover the cost of the rest of your contract should anything happen to your TV which would be classed as accidental damage, such as your son accidentally cracking the screen.

hey i need help march 24 2010 i got a 47"baird tv from brighthouse which is a load of rubbish i was aware that brighthouse was not a friendly service to customers but i thought i would be ok,wel anyway i am paying something like £19.54 every week without no problem until i lost my job and now on job seekers so i have had to pay out of that but as it was making me skint i thout i get my osc and dlc taking off to make it cheaper but they said i couldnt do this even though it says optional but not only this a week after i lost my job i did tell them i be getting paid from work every 2 weeks on a monday usually my payment was due on a saturday (because i didnt want them to know i was out of the job) anyway they said no problem as long as i keep up with payments when it came to my payday they said i would have to pay £42.08p well i knew i would have to pay double as i get paid every 2weeks but i got given a latecharge even though i told them well after argueing with them i ended up paying but told them i wouldnt pay a late charge again,well time came to pay up again with another late charge this time this bloke served me i told him my troubles in the past with brighthouse and with the late charges made against me also i told him about my delivery my delivery i was not happy with as it the first time they delivered they never installed it for me just dumped it in my frontroom for me to sort out so i complained as the tv built in freeview was also not working so they agreed for a replacement tv which i was happy with this time they did install it but left me with all the packaging left pieces of cardboard and stuff from thier van all over my garden and i am pretty sure the tv looked second hand but after a while when i am watching the freeview it will say no signal and wipes off my channels and i have to install it everytime.Well back to the store the bloke said i would have to pay my late payment i said no but gave him £40 quid so i was paying what i really owed BH and said if i have a few quid spare i will pay off the late charges later on this week well 4 days later this morning i have some screechy women ring me from brighhouse 9.30am asking me to come in and make a payment i said i be popping in to sort it out then she hung up.i still have no moni to pay for it i know its only a few quid but its gna keep building up.i want this sorted out when i go in today can i get to cancel my contract legally and get a full refund or get a refund on my delivery and use that to pay my charges and can i get the osc and dlc taking off

You can get OSC taken off. It is optional, put it in writing that you want it removed from your contracts and they must do this. You can only have DLC taken off on the condition that you have home contents insurance that covers hire purchase, BH will need to see copies of your contents insurance for it to be removed.

 

If you have had your TV for more than half of the time your contract is due to end, you can request (again in writing) that they take the TV back and cancel the contract, however you will be entitled to no refund on payments already made. BUT the easiest way to sort this out would be to go into BH with a letter stating that because you have being paying OSC on your contracts, and you can no longer afford repayments, you need them to come pick the TV up as you want the contacts removed. Again, no refund for payments already handed over.
