  1. Yes, repairs were carried out at a VAT registered garage. He has a written bill, marked paid under protest! The bill was £838 inc VAT. I have checked his policy and the maximum payment is £2000 in 12 months, however the maximum payout on one individual claim is £500 less a £25 excess. So the most he can claim is £475.00 of the £838.00..still better than nothing! He's on holiday for a few days now but I rang him and he is prepared to go to the small claims court. LBA will take a fews days longer to send as a result Thanks again for the advice !
  2. He stipulated 7 days from the date of receipt of the letter. That would take it to August 2nd or August 4th counting only working days.
  3. The letter was sent on July 24th and signed for on July 26th. I have seen the electronic proof of signature No reply as yet though and its now 8 days since then. The T and C's of the policy do say that it should be a VAT registered garage where any authorised repairs are carried out. What do you think my friends next step should be? Many thanks
  4. Ok, I've got some more details from my friend as to what has actually gone on here. He's had the car 5 years, btw, and had it regularly serviced. The problem with oil in the water coolant was discovered by his little local garage at the time of the latest service and MOT. When he contacted the AA initially they told him that the repair work had to be done by a VAT registered garage. So when the AA patrol came out to confirm the diagnosis of what was wrong, my friend drove the car to another bigger local garage, with the AA van following in case of breakdown. Over the phone AA Insurance have told my friend that by driving the car, after the discovery of the fault, the fault has become "ongoing"!!!!! But they told him to drive it!!!!.. They have also said that it will take up to eight weeks for them to confirm this is writing as they are "exceptionally busy"........ This is just totally unacceptable in my opinion...

  6. No, I've sent them the "Failure to respond to a CCA request" letter putting the account into dispute. This "four weeks to respond" tactic seems to be cropping up all over the Cap 1 thread and seems to be a standard letter when they don't quite know what to do. Why send a letter saying it will take four weeks when the statutory limit is 12 + 2 days?..totally beyond me...
  7. I hope that someone can give me some advice to pass on to a friend who is having problems with the AA and their car repair insurance scheme. He has a 2000/01 Vauhall Astra diesel estate. He recently noticed oil in the water coolant and took it to his local garage. They diagnosed that the head gasket had gone and that it would be about £800 to repair fully. He had taken out insurance with the AA for such repairs and they sent out a patrol who agreed with the garage. The AA then asked for copies of the car's service history and MOT's before they would authorise payment for the work On seeing these they rang my friend and asked why at the last MOT the car had initially failed the emissions test but then passed with flying colours afterwards.The answer to this was that the car was serviced in the meantime!! They also queried that the service invoices were hand written rather than computer generated, this being because the garage is small and not even VAT registered. After a couple of days they wrote to my friend declining his insurance claim on the grounds that the problem with the car was an "ongoing problem" and therefore was not covered! My friend has paid the bill, as he needs his car back but written "Paid under protest" on the invoice. He has also written to the AA asking how such a problem can be regarded as ongoing but is yet to receive a reply. If they refuse to pay up, as seems likely, what should his next step be? Thanks for any advice.
  8. Tjjbkh, the letter you received sounds exactly like the one I received when I sent them a CCA request!. Was it from Sven Lagerberg?!!
  9. Just when I said it had gone quiet I had a letter on Saturday from Sven Lagerberg, "Head of Executive Response Centre" (!!) This says that Cap1 are "looking into my situation and will do everything they can to get an answer to me within four weeks"...!!!! "If for some reason our investigations take longer than four weeks we'll contact you and tell you why this is.." Don't they realise they have a statutory time to reply? ...or is it that they simply can't find my original application form?? I originally applied around 2003. Sent off letter 20 as suggested and I'll keep you all up to date with developments.
  10. So I should send this to FPC? The last letter from Cap 1 said that the whole account had been transferred to FPC and was no longer in their hands. I haven't sent an SAR to Cap1 yet. I was first waiting to see what the response to the CCA would be...and the answer to that is nothing!
  11. I CCA'ed FCP on 25th June. Since that date I've heard didley squat. No phone calls, no letters, nothing, its been eerily quiet! So my next step? An account in dispute letter to FCP or is there something else I should now do? Any advice please?
  12. Definitely FPC Debt Collection Services, their address is a PO Box in Weybridge, Surrey. On their letter they also state that payments "in some circumstances" can be taken by credit card. Isn't this also against OFT rules?
  13. Miss Muppet, it is FPC, not what I put in the title, sorry ( There has been no letter of assignment, just letters from oc and FPC to say FPC are now looking after this account. I sent off the cca today to DCA, let you know when I get a reply. So Sven is well known?!!..really odd to get a letter that was almost sorry that the PPI was cancelled when it was CapOne that caused it to be cancelled!!
  14. Hi Littledotty, Our nephew lives with us as his mother died and father unable to cope. He is nine and was diagnosed with ADHD last year. Up until then his behaviour had been out of control and the school were on the point of excluding him. He is now on 20mg of Ritalin a day and the effect has been really good. He is much calmer, but not zombified, his concentration levels at school have improved 100% and he is generally a pleasure to have around. We were also worried about Ritalin but tbh its really worked well for him. His height and weight are assessed every three months and, although his appetite is slightly reduced (he did have "food issues" when he came to live with us) he is still growing normally and putting on weight. So Ritalin, in my experience is worth a go. It doesn't work for everyone, but just monitor it closely and hope for the best. Hope it goes well!
  15. Thanks for the advice Miss Muppet and Craigbadger. I will get off the cca today. Yesterday I received a big yellow card inside an envelope from FPC. In big letters across the card it said "Address Confirmed" and then lots of bumf about them confirming that I lived at my address...not that I ever said that I didn't!!. Obviously its an implied threat to send someone to the door..) I've already written to them telling them to only contact me in writing, using the template letter. I also had a TWO letters from Capital One. One from Graham Robinson replying again to my offer of payment and simply saying that the debt was now with FPC and one from Sven Lagerberg regretting that my PPI on the agreement had been cancelled by me...but I didn't do that, THEY did, when they terminated my agreement. Is this normal?!!! Btw, when the debt was passed to FPC, should I have received any sort of notice of assignment? I'll keep you up to speed with developments...and thanks again for the advice, much appreciated!!
