Hello Guys,

 

I am really glad to see such a this kind of forum!

Can anyone explain to me how I go about claiming back some charges I had been taken from my account by RETURNED DIRECT DEBIT please?

I had four times charges with £20 each time from the last 3 months.They sent me letter to notice me that I have overdraft actions and it will charge.But I saw the overdraft was failed eventurely and it became to a returned direct debit and I did not know what it is.Till now it charged fees for £80 (four times) then I finally found out it has a charge.I feel mad that it was not a successful overdraft and they did not give any help but made these returned direct debit charges.

I have my bank statments and overdraft notice letters from bank.But my english is not good,I do not know how to write the letter to claim my money back.Please give some help as you can.I am so mad at this and I give greatful thanks to you!

Firstly, you will need to send a SUBJECT ACCESS REQUEST letter to them, you do this because you want them to provide you with detailed information about these charges to your account and possibly other charges that they may have applied also.

 

Secondly, let me just inform you that the OFFICE OF FAIR TRADING considers a charge of £12 to be reasonable, but charges of £20 or £30 or even £40 are considered to be excessive.

 

 

With this letter you must include a fee of £10, this is the maximum that the bank (data controller) can charge you for your Subject Access Request, you probably know this bit, in English Law there is a statute (legislation) called the Data Protection Act, this Act is regulated by the Information Commissioners Office, so by law, when you (data subject) make this request in writing with the £10 fee enclosed to the data controller who holds and processes your personal information, the data controller must comply with your request in 40 days.

 

Send this letter to them, first though, phone their Head Office and ask for the adddress details of their 'Data Subject Access Request Department' or the 'Compliance Department' details.

I also request that you provide me with a copy of my account agreement including all of the terms and conditions that applied at the time of my opening the account, a copy of any changes to the agreement that you may of introduced since the time of opening the account and a copy of any terms and conditions that may apply to present day banking and transactions to the account.

 

Finally, I request that you provide me with a comprehensive list of all charges that you have applied to my account dating back over the previous six (6) years, to include, showing what the offence was, the date of any such offence and the amount applied as a charge to my account.

 

In relation to the above paragraph, I respectfully request that you justify any sum amount that has been applied to the account to show that the sum amount (charge) does indeed reflect actual costs incurred and not exceed any damages the bank may have suffered due to any breach of contract to the account.

 

I trust that you will make as serious effort to understand your legal obligations under the Data Protection Act and provide me with all that I have a legal right of entitlement to under the said Statute.

 

According to the Information Commisioners Office the maximum fee that you may charge for my Subject Access Request is £10.00 (ten pounds) and so I therefor have enclosed the required fee.

This is Gerald,long time no see.

I had just received letter from TSB DPA agency after following your advices.And they only sent me my entire bank statments with nothing else and also took my £10 check.

If not give them the full 40 days as in my experience they sent the info in 2 or 3 different parcels.

I think it is 22 days past.

I have received 1 letter from them till now which it is about my entire bank statment in last 5 years.And it says if there are any question,please go my branch bank and talk with them.

I'll keep waiting till the days up.
