I have recieved 2 letters from different debt companies but dated a day apart, 1) wescot and the other Moorcroft. 1 saying they want me to pay 12.48 a month and the other asking for the full amount, which company do i deal with, or anyone got any other advice

Is this two seperate debts?

hi, yes the debt is mine, its from when i cancelled my three contract and was messed about for 4 months before i finally got a final bill. its 1 debt all info on the 2 letters are the same, eg client reference num is the same as my customer num for three.

Dear Sir/Madam

 

You have contacted me regarding the account with the above reference number, which you claim is owed by myself.

 

I would point out that I have no knowledge of any such debt being owed to (xxxxxx).

 

I am are familiar with the CPUTR 2008 and the Office of Fair Trading's Guidance on debt collection, which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. AND in not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

 

I would ask that no further contact be made concerning the above account unless you can provide evidence as to my liability for the debt in question.

 

I await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to Trading Standards and also inform the Office Of Fair Trading of your actions.

They are in breach of the OFT debt collection Guidelines;

Physical/psychological harassment

2.5 Putting pressure on debtors or third parties is considered to be oppressive.

2.6 Examples of unfair practices are as follows:

c. using more than one debt collection business at the same time

resulting in repetitive and/or frequent contact by different parties

 

Make a formal complaint to the OFT/TS via Consumer Direct

 

Don't speak to them over the phone EVER!

if it were me i would wait until they supply proof of debt and that they can legally collect on it..you could be paying these idiots forever and a day...make them do some work for something they paid pennies for...

What is the total debt outstanding, have they or 3 added any charges to it?

 

IMO I would be paying 3 and not his tin pot DCA.

personally I would send moorcraps letter to westcrap and vice versa with a note attached saying would the supposed legal owner of the debt please step foward:D
