PCN Sunday parking single yellow line, NO SIGN

Last December we parked behind a van on a single yellow line on a small stretch of Hackney road between Hassard street and Ravenscroft street on a Sunday morning. Cars were parked all around us on either side of the road.

 

There was no sign whatsoever indicating that the usual single yellow line Sunday parking rule didn't apply to this specific stretch of road .

There was `single pole', which might have had a sign in the past, but it was clearly missing. There was therefore no way for us to know that this part of the road wasn’t free for us to park on a Sunday morning.

 

We understand that yellow lines have to be continuous, unbroken and end by T-bar. If there are breaks in the line, and in our case there was as we had a zigzag and a zebra crossing in front of us and a T-junction behind us, there must be a sign.We did check at the time and believed, because of the above, that this particular stretch of the road was OK.

We took pictures at the time and sent them with our appeal. However when we checked the google pictures later it clearly shows that the sign for no parking was on that pole. We therefore concluded that if the sign was there in the first place it was because the relevant authority decided it was needed (by the way I went back last Sunday and there is still no sign on that post!!!!!).

 

We contested the ticket but to no avail !

We do not quite understanding their reply either;

"By law, yellow lines must have a T-bar to show where they terminate or change from either a double to a single or visa versa. The only exceptions are if a yellow lines meets a parking bay or a Zebra crossing. In this instance it was noted that the above vehicle was parked on Yellow line that meets a Zebra crossing. Furthermore, it was noted that the restriction time for this location is &am to &pm, Mond to Sund. Therefore , I am unable to cancel this PCN because it was correctly issued"

 

Because the bit of road behind us was the junction with Ravenscroft road, we assume that it is a break in the road. We now also understand that Traffic Regulations should be matched by signage therefore a single yellow line on ground is not enough????. There were small yellow signs further up and down the road but after " road breaks " IE the junctions from the two adjoining roads mentioned above.

 

To add to the confusion and make matters worse, the side where we parked is Tower hamlets, the other side is Hackney and ...........they allow single yellow line parking on Sundays!!!!!

 

Can someone please enlighten a very confused driver ????

Our appeal was rejected and we are now about to proceed on to the next step ! Their reply to our appeal said in essence ..."signs were further up and down the road".

Our argument is that there was no signage on that stretch of road in between those 2 adjoining roads, therefore in between these 2 breaks in the yellow line....

 

Just want to know what exactly the law says and whether we are totally stupid in pursuing it or are they trying to scare us into submission.

196 Hackney road shows where we were parked with Ravenscroft road behind us. We were just behind the pole.

If you place the little man on the corner of Hackney road & Ravenscroft rd it will show that stretch of road with zebra crossing at the end.

The time-plate is clearly visible outside the Post Office

on Street View, but as you say, it's obviously missing now.

 

The next SYL time-plate is 75/100 yards away, just after the junction

on the same side of the road outside the dry cleaners shop.

My area of knowledge is loading/unloading/delivery/BB, so I know that I

could have stopped there for those reasons, and that I could also park

there with Mum's Blue Badge. But personally, and with the greatest of

respect, I would have looked for the next time-plate either side and given

what was to be found I wouldn't have parked there..

 

Personally, I feel that the Council concerned should be using a little

discretion and admitting that the plate is missing and that they should

cancel the PCN as a gesture of goodwill, if nothing else..

 

Can you post the photo of the missing plate ?

 

But best wait for a more qualified opinion methinks..

Thanks for trying to help, yeap you are right but I've been parking around there before and saw how vicious the warden are around the area ( Columbia road Sunday am Flower Market) so I was very careful when parked and truly believed that that area was OK to park. Didn't realise that across the road was an other council (Hackney)and cars were parked all along road. In front after junction with Hussard road is a CPZ area with its own regulations. Behind after junction with Ravenscroft was restricted but in my maybe naive understanding it was after a T junction therefore different rules may apply. We didn't notice the "missing sign pole" until after. It could have hosted anything????

-RESULT -

Pleased to say we have just received a letter saying that they will not contest our appeal and the forthcoming hearing has been cancelled. VICTORY !!!!!

Advice to anyone

DON'T LET THEM INTIMIDATE YOU, IF YOU THINK YOU ARE RIGHT, FIGHT THEM.....
