Just from reading about other posts either the bank or the court could but not guaranteed to merge.

 

the bank probably would as they know it adds more pressure to us "the little people" and more likely to scare us.

 

Once you have done the first claim think of it as the bank are actually paying for the second claim as the cash you are paying with was once theirs:p

 

I plan on banking the first payout I get and using that for all of my claims, so it is not actually my money I am spending.

Hi, don't claim any interest untill you sudmit your claim to the court.

That's what I've been told.

Hi

Update. I claimed £746.84 (£632.00 + £114.84 int) for the period 23/7/01 – 27/5/05.

I have been offered £694.00 as full and final settlement of my complaint regarding bank charges made on my Bank of Scotland accounts. No mention has been made of specific dates.

I have another 2 claims ready to make on this account one for £607.27 for the period 1/6/05 – 30/8/06 and another which is ongoing.

I am prepared to accept the £694.00. What is the best way to achieve this?

Can I simply change

‘’in full and final settlement of our complaint regarding bank charges made on our Bank of Scotland accounts’’

To

‘’on the condition that it is a partial settlement and that I can continue with my claim.

Or

Do I

Add during the period 23/7/0127/5/05 at the end.

Would appreciate some advice

It's up to you really, the difference is about £50 isn't it? so, it depends how badly you need the money now or if you wanna hang in there, it's a meal out with the missus!!!;)

 

If you do accept, then make it very clear what you're accepting, state the claim number and the dates for the period which you're claiming just be be on the safe side. Tell them that you will be pursing the other charges and your acceptance of this offer is only as a part-settlement of the full claim against the bank.

 

Or something like that anyway! lol

Received letter from bank basically withdrawing the previous offer and advising me to refer my concerns to the Financial Ombudsmann Service.

Question

Should I phone and try to negotiate or start court proceedings

this seems to be the latest ploy, I was offered a sum before I even got my statements, wrote to accept as part payment and got a letter back saying as I rejected the offer I could sing for any cash.

 

When I got my statements the charges were for almost 3 times the offer and the interes another 2 times the offer.

 

LBA now issued and waiting until mid next week to file my claim in England so I can go for it in 1 visit.

 

I wouldn't even phone them, so long as you have done the prelim and LBA and timelimit has expired go get em.

What have you done so far?

 

Have you

 

1 - sent a prelim for less than £750 then plan an LBA for less than £750 or

2 - did you prelim them for the full amount then plan an LBA for full amount but only claim for less than £750 in court each time?

 

If you have done 1 above then if it was me I would probably start again as it is only 14 days and it will save time in the longrun.

 

If you have done 2 then all you have to do is issue the N1 form to an English court on the leeds address,

I have LBA'd 1 account and waiting for my second LBA time to be up next week then I will be issuing 1 court form for both.

 

I use the Morpeth court as I am in central Scotland too and it is the closest county court to me.
