I can prove that I had to buy a new washing machine, I have my pay slips showing the emergency tax code and a letter from the tax office after I had spoken with them to get it corrected and of course I can get a copy of my vet bill. And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

I've got a total of about 50k debt and I'm currently in an IVA where it has been agreed that I pay back about £22k over 5 years. After about a year of payments on the IVA I got made redundant at work and my payments were put on hold. They have been on hold for about 8 months now and I had a letter telling me that they had cancelled my IVA agreement. I got a new job in December but the pay is nothing like I was earning before and can't even afford to live let alone pay back the IVA too which is £370 a month. So it looks like I have no choice than personal bankruptcy. I'm fine with this and to be honest it feels like it could be the best option for me.

 

My main question really....and the reason for finding this site....is I only really have 1 asset which is my car. It's worth about 4 or 5k. The thing is I really can't be without a car as I need it at the weekends to see my children. I was guessing that if I declared myself bankrupt that they would take my car for auction. Is this true?? Is there a bottom limit on how much a car is worth before they can take it from you....for example...would it be worth me selling the car I currently have and then buying one for around £1500>?? would I stand more of a chance of holding onto a car then??

 

I'd be grateful for any advice on this....thanks in advance.

Hi and welcome to CAG,

 

You are correct in your assumption regarding the possibility of the sale of your vehicle, if it is deemed to be an asset then the OR would sell it and use some of the proceeeds to settle your debt.

 

A personal vehicle (car, van or motorcycle) is allowable during BR and I would reckon the ceiling value should be no more than about £1000 in order to guarantee avoidance of the OR's interest.

 

Be aware that when you sell your vehicle, the proceeds must be accounted for.

 

The vehicle must be sold for a reasonable (market value) sum

The disposal of the proceeds of the sale must be accounted for (to the penny)

 

If the OR feels that the sale is a deliberate attempt to avoid your liabilities, or is in any way underhand or evasive, they have the power to reclaim the vehicle and hold you liable for the financial implications, this can also have an impact on any sanctions which may be applied to your BR (the amount you may have to pay out of your disposable income)

It really depends on what the car is needed for.

 

Do you need it to get to work?

Do you need it to see your children?

Do you need it due to a medical or disability?

 

The key word here is "need" not use.

You maybe asked if it's not possible to use public transport.

Check out if any of your journeys have public transport and how much they would cost vs the running of the car.

I worked out that for me to get to and from work would cost me the minimum of £220 per month and at least triple the time to and from work!

 

Check out the value of your car at New & Used Cars, UK Car Dealers - Parker's, as a guideline the OR uses the "poor value".

 

Another CAG user "Socktug" has recently went through the BR process and he was allowed to keep his car as it was under 4K, http://www.consumeractiongroup.co.uk/forum/show-post/post-2789332.html

I have just filed and i'm due in court shortly, my car is under 1000 so i'm fairly sure it will be safe, depends on the OR I guess!

Hi, just to add that if as the obove posters decides that you need your car but it is just worth to much then what they usually do is put the car through auction and give you £2,000 back to buy a cheaper car, so there really isnt a need to sell it beforehand

Its usually £2,000 but depends what its for

 

If its for work /see kids it all helps

 

A car that breaks down (cheaper is of no use)

 

Depends if your kids are 3/4yrs old or 20yrs old.

 

If you car is worth £5,000 they may ask you to get a cheaper one and I wouldnt mention the Bentley :)

When I declared myself bankrupt in 2006 I had a car valued at around £4-5k.

I was lucky because of the distance and traveling time to and from work I was allowed to keep it.

 

 

It's been 3 years since I have been discharged from bankruptcy, up until aquiring my credit file from Experian a few months ago I had been finding it very difficult to even open a bank account

 

Keep an eye on your credit file after you are discharged although your offical receiver writes and informs all of your creditors.

My creditors still had all of my debts listed as defaulted showng an owed balance.

They should have read defaulted satisifed which they all do now.

I have just been told by Reveiver that as long as vehicle is not worth more than £3000 it will not be touched and has now been made exempt.

Im no expert but thought i would mention it as i was told this yesterday
