I am sorry to hear your story dwp will stop at nothing to make sure we don't get anything we need to fight for our rights if you don't get any luck there are the Disability Law Services and the Social Security Commisioners please search on the net for contact address or numbers and tell them your stories they might help out, I will be seeing legal aid on Tuesday next week I shall see how it goes, I am so ill and tired all the times I was at the job centre to sign on yesterday there was a lady at the next desk as me my advisor said to me the lady has celebral palsy she is very ill I told my advisor what the hell is this woman doing here if she is so sill what the hell is going on she said well there are some people that do wish to work even they are sick but at my job centre they are very sympathetic they let the lady go as soon as possible amd myself also I usually just spend 5-10 mins with them I am in the disability dept though they don't tell you to look for work they try to help you get better.

 

wish you all the luck will be thinking of you I too will let you know the outcome. I agree we must all fight we must unite in this it has to stop but until we group in numbers and fight nothing will happen. If ever you decide to fight back I shall be standing next to you.

Welfare rights are not closing my case till sorting this so I will have help if they do decide to ignore my medical evidence and fail me again. When i first failed ladies at job centre were really good and tried to help. They put in my appeal and request for review. She even stated how urgent it was and the state I was in but even that fell on deaf ears. they took 6 months to review the decision which they did not change despite supporting evidence to do so. First time I even saw the ATOS report was when sent the tribunal papers and they conveniently lost my ESA50 but said it would have been available to the doctor at the time, but from his report this had obviously not been read. Luckily a friend had already advised me to make sure I copied the ESA50 before sending it in so I was also able to supply the copy of the original ESA50 as well as additional supporting medical evidence from specialists as well as my GP. Even the work advisor was nice, told me not to be so hard on myself and that I just needed some time to recover, but since i failed the medical, though I have rung numerous times never calls back.Will keep you informed and once I do get better I intend to continue to fight to stop this type of barbaric treatment. NOONE has the right to treat another in such an inhumane way including our poxy government who are a waste of space. I would like to subject them to what we are being subject to for a few weeks and let them see and feel what it does to you.

Hi SuSu and well done! Seriously. 9 out of 15 is considerably higher than most of us score! Many of us get 0 points...

Do make sure you appeal. Have you let the DWP know so that your ESA will continue at the assessment rate?

Be prepared for a long wait as, not surprisingly, the tribunals service is buckling under the weight of appeals.

Please don't take the 'medical' either personally or seriously. They are an absolute joke.

Do prepare for your appeal and enlist a Welfare Rights worker - through CAB or your local council. I'm sure you'll have every success :)

That is really reasuring to know, Atos failed me with 6 points, medical assesment is unfair, system is corrupt. (edit) My Mother recently passed away, and I became depressed, I am an only Child With no family of my own, it became immpossible to act normal at interviews and chase Jobs. Since then I have been targeted 5 times by the Goverment, having my Benefits stopped, I dont have any savings, a nightmare. Thanks for the advise, I shall ask for my Benefits too be reinstated while i appeal.

I have no Welfare Rights Officer in my area and the CAB said they can't represent me at the Tribunal.

 

I did a search for "Advocacy" and found that our local Mental Health Forum have an Advocacy Service.

 

This could be vital for me because statistics show a much better chance of winning an appeal if you are represented.

 

I'm up next Monday and a win would be a massive boost to my morale.

Yes HB, it is a week today. I have sent in (months ago and it has been acknowledged by the tribunal service) a four page letter based on the template from the Ben. & Work website and a letter from my GP backing everything up.

 

A win will be great and I'll get my IB back with a load of back-pay. BUT I am still depressed because I know I will be migrated to ESA next year and end up on JSA and I'm too ill to work.

 

Nice to win a battle but this is a one-sided war.

I agree it is a one sided war but it's a war that can continue for eternaty under the current rules.

 

I won my appeal 2 weeks ago, i fully expect to recieve another ESA50 early next year, then the "medical", followed by 0 points, closely followed by my appeal, again.

 

If they, in their infinite wisdom continue to ignore properly qualified medical opinion and refuse to give me the time i need and the benefit i've been paying into for almost 30 years, (not to mention my 3 working siblings, my parents and their parents), then i'll continue getting worse, so i feel no guilt. Let them deal with the extra expense of this.

 

But i'm not going to let it effect me like it did this time, come what may, i will continue getting esa UNTIL I KNOW/DECIDE i am able/fit to work, or i'm advised to, by the people this government pays to look after my health, which is my GP and mental health team. Or they move the goalposts again.

 

I feel that if i had recieve the benefit i was entitled to in the first place then theres a good chance i'd feel upto at least part time work by now. Instead, my depression, anxiety ect have developed into a full blown mental illness caused as a direct result of their decision.

Rbs £114 + contractual at 29.84% I won total=£125 no laughing it's a win

Don't moan about it DO SOMETHING ABOUT IT :D

Well said Hadenough. It's made me too ill as well. I was looking at voluntary work with a view to part-time work in the future but I'm in so much mental and physical pain now because of THEM that I can't cope.
