Honestly don't know how the others got through it..

 

I'm just the unlucky one I suppose.

 

I would def recommend taking a solicitor because it was me (regular Joe) VS a professional solicitor.

 

I who know nothing well only what I have been told on here and to the judge who couldn't care less said "you shouldn't believe everything you read/get told on the Internet" Against a professional solicitor..

 

End result LOST...

 

I personally think I had a Crap Judge, I'm just really annoyed at the moment...

leon i would recommend then that you call stephensons..they are experts on the ycc agreements..what court did you attend m8? cos the judge you got sounds like he knows nothing of consumer law at all..to be honest i am totally gobsmacked...his ruling is incorrect..you must be allowed to speak to the person issueing stat demand otherwise it is invalid....i would certainly give above a call and tell them what has happened..also your statement that he then granted the stat dec to be dismissed with costs...is it dismissed or what? godebt now have 21 days in which to declare you bankrupt...which will cost them another grand or stat demand will be null and void..once again i am extremely sorry and disappointed to hear this

A statutory demand must show a named person or persons from the Creditor or their agent/solicitor whom you can contact directly. This is Rule 6.2 of The insolvency Rules 1986.

 

This means that if the statutory demand doesn't give the name of a person you can speak to then it is not valid. If you try to contact the named person and they won’t put you through then it is also invalid.

 

 

this is case law...and judge told leon it doesnt apply!!!!!

Has Leon27uk's Stat Demand response been posted on here?

 

I wouldn't mind having a peek at it to see if we can tighten it up a bit for future caggers.

its on page 7 postggj did it for him can see no reason why the judge has totally dismissed case law...i am wondering if post has any thoughts on where we can go from here....this should have been thrown out....it is almost as though the judge has decided that case law doesnt apply and has gone with his own ruling

The SD response doesn't mention any of the many holes in the agreement (deposit off insurances, PPI mis-sold etc..), should these have also been added?

 

The mention of the SD being invalid and the bit about the termination notice should probably have been a side issue but the main points should probably have been about the agreement itself.

 

I'm just heading out the door for a few hours so I'll have a good read through the thread later.

I know Post thought he had mentioned more than enough to have this set aside...

The judge had def made up his mind before I went in there; as I said before he wasn't budging and without actually saying it he was urging me not to persue it.

its an argument post has used many times and won..ok maybe in future we should be including the holes in the agreement..however i do believe the judge has stamped all over the arguments and taken no account of what was written..including not being able to contact person on stat demand...it should have been thrown out for that alone

I have been just having a good look at the Stephensons website and it says they will look at the Credit agreement for free and can offer a No-win No-fee sevice which would suit me fine. I'm sure that if I did win they would be able to claim costs from go debt rather than me and if thats the case shouldn't cost me a penny!!! I'll confirm that tomorrow after I speak to them. ;)

What happened with GDK in the end because he used these solicitors... Last I read he was waiting for Go Debt to sign it all off. Did this ever happen??

yep godebt admitted agreement ****e and signed off on it....strange because it is the same arguments we have been using in fact he very kindly gave us the arguments that they used to beat them...which is why i am so ****ed for you with this judgment....
